Because of a default in the payment of the indebtedness secured by a Security Deed executed by Timothy S. Rice and Jennifer L. Rice to Homeside Lending, Inc. now Washington Mutual Bank dated December 19, 2001, and recorded in Deed Book 191, Page 189, BANKS County Records, securing a Note in the original principal amount of $84,600.00, the holder thereof pursuant to said Deed and Note thereby secured has declared the entire amount of said indebtedness due and payable and, pursuant to the power of sale contained in said Deed, will on the first Tuesday, February 7, 2006, during the legal hours of sale, before the Courthouse door in said County, sell at public outcry to the highest bidder for cash, the property described in said Deed, to-wit:
All that certain parcel of land situate in the City of Maysville, 465th District, G.M., County of Banks and State of Georgia being known and designated 0.459 acres, more or less, as shown on a plat of survey prepared for Timothy S. and Jennifer L. Rice by Roy A. Terrell, Registered Surveyor, dated August 21, 1996, recorded at Plat Book 21, Page 58, in the Office of the Clerk of the Superior Court of Banks County, Georgia, and incorporated herein and made a part hereof by reference for more detailed description. Said property is bounded on the North by Lot 10; on the East by Lot 5; on the South by Lot 8; and on the West by 40 foot right of way of Fair Street.
Said property is known as 127 Fair Street, Maysville, GA 30558, together with all fixtures and personal property attached to and constituting a part of said property, if any.
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.
Notice has been given of intention to collect attorney’s fees in accordance with the terms of the Note secured by said Deed.
Said property will be sold as the property of Timothy S. Rice and Jennifer L. Rice, the property, to the best information, knowledge and belief of the undersigned, being presently in the possession of Timothy S. Rice and Jennifer L. By virtue of the power contained in a Deed to Secure Debt executed and delivered by Edward R. Tatro and Keitha L. Tatro to Tommy Watkins Construction Company, Inc., dated January 10, 2003, and recorded in Deed Book 206, Page 471, Banks County, Georgia Records and recorded securing a note of even date, and any other present or future indebtedness, in addition to interest accruing, there will be sold at public outcry to the highest bidder for cash, before the Courthouse door in Banks County, Georgia, by the undersigned, acting as Attorney-in-Fact for the said Edward R.
