Under and by virtue of the Power of Sale contained in a Deed to Secure Debt given by James Smith and Merlean Smith to Popular Financial Services, LLC, dated December 23, 2003, and recorded in Deed Book 33-D, Page 135, Jackson County, Georgia Records, as last assigned to Sovereign Bank by assignment recorded in Jackson County, Georgia Records., conveying the after-described property to secure a Note of even date in the original principal amount of $86,490.00, with interest at the rate specified therein, there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door of Jackson County, Georgia, within the legal hours of sale on the first Tuesday in August, 2006, to wit: August 1, 2006, the following described property:
All that tract or parcel of land, with all improvements thereon, situate, lying and being in the 255th (Minish) GMD, Jackson County, Georgia, and being more particularly described as follows: Beginning at an iron pin corner of Vallie Darnell on north side of Old Maysville Road, thence along old line with Darnell north 17 degrees east 400 feet to an iron pin comer on Harden land (Robert McDonald Darnell lot), thence along Harden north 72 1/2 degree west 105 feet to iron pin corner of Will Ledford line and new corner of Parker, thence new division line south 72 1/2 degrees east 93 feet to new corner at drive, thence south 17 degrees west 215 feet to point on road, thence south 72 1/2 degrees east 12 feet to the beginning corner, and being the northern part of the Parker home lot, together with a 12’ driveway along eastern side of lot to road.
This is the same property conveyed by deed recorded in Deed Book 17-K, Page 117, said records.
The debt secured by said Deed to Secure Debt has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Deed to Secure Debt. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Deed to Secure Debt and by law, including attorney’s fees (notice of intent to collect attorney’s fees having been given).
To the best knowledge and belief of the undersigned, the party (or parties) in possession of the subject property known as 2934 Old Maysville Road, Commerce, GA 30529 is (are): James Smith and Merlean Smith or tenant or tenants.
Said property will be sold subject to (a) any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), (b) any matters which might be disclosed by an accurate survey and inspection of the property, and (c) all matters of record superior to the Deed to Secure Debt first set out above, including, but not limited to, assessments, liens, encumbrances, zoning ordinances, easements, restrictions, covenants, etc.
