The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorney’s fees. The indebtedness evidenced by the Note is due and payable and remains unpaid. The Deed to Secure Debt therefore has become and is now foreclosable according to its terms. Accordingly, the Premises will be sold at public outcry pursuant to the terms of the power of sale provided in the Deed to Secure Debt.
The Premises will be sold on an “as is, where is” basis without recourse against Lender and without representation or warranty of any kind or nature whatsoever by Lender with respect thereto.
The proceeds of the sale are to be applied first to the expenses of the sale and all proceedings in connection therewith, including attorneys’ fees (notice of intention to collect attorneys’ fees having been given), then to the payment of all sums secured by the Deed to Secure Debt, and the remainder, if any, will be paid to the person or persons legally entitled thereto, all as provided in the Note and Deed to Secure Debt. All that tract or parcel of land known as 10 numbered lots within Tumbling Creek Subdivision, together with all improvements thereon, situate lying and being to the northwest of the intersection of Georgia Highway 72 and Georgia Highway 172 in the 382nd G.M.D. of Madison County, Georgia, and being shown and designated on that plat of survey entitled “Survey For: Final Plat Tumbling Creek Subdivision” by Ben McLeroy, Georgia Registered Land Surveyor No. 1184, dated April 21, 2005, revised May 3, 2005, May 11, 2005, and July 19, 2005 and recorded at Plat Book B145, Page 003A, Madison County Superior Courts Records, which plat and record thereon are by reference incorporated herein, and being more particularly described according to said survey as follows:
Block A, Lot 20; Block A, Lot 21; Block A, Lot 22; Block A, Lot 23; Block A, Lot 24; Block A, Lot 25; Block A, Lot 26; Block A, Lot 27; Block A, Lot 28; and Block A, Lot 29 (the “Land”).
TOGETHER WITH all buildings, structures, and improvements now or hereafter erected on the Land; all tenements, easements, rights, appurtenances, reversions, remainders, rents, royalties, rights and profits to, from and appertaining to, the Land; all minerals, oil, gas, water, water rights, and water stock rights to trees, crops, timber and shrubs now or hereafter on the Land; all equipment, machinery, and fixtures now or hereafter attached to the Land, all of which, including replacements and additions thereto, shall be deemed to be and remain a part of the property covered by the Deed to Secure Debt; any and all awards or payments, including interest thereon, and the right to receive same, as a result of the exercise of the right of condemnation, eminent domain, the alteration of the grade of any street, or any other injury to, taking of, or decrease, in the value of any of the foregoing property.
The indebtedness evidenced by the Note is due and payable and remains unpaid. The Deed to Secure Debt therefore has become and is now foreclosable according to its terms. Accordingly, the Premises will be sold at public outcry pursuant to the terms of the power of sale provided in the Deed to Secure Debt.
The Premises will be sold on an “as is, where is” basis without recourse against Lender and without representation or warranty of any kind or nature whatsoever by Lender with respect thereto.
The proceeds of the sale are to be applied first to the expenses of the sale and all proceedings in connection therewith, including attorneys’ fees (notice of intention to collect attorneys’ fees having been given), then to the payment of all sums secured by the Deed to Secure Debt, and the remainder, if any, will be paid to the person or persons legally entitled thereto, all as provided in the Note and Deed to Secure Debt. The Premises shall be sold as the property of Grantor, subject to all restrictions, easements and other matters of record that are prior to the Deed to Secure Debt and to which the Deed to Secure Debt is subject and to any unpaid city, county and state ad valorem taxes or assessments relating to the Premises.
To the best of the undersigned’s knowledge and belief, the owner of the Premises is the Grantor and the party or parties in possession of the Premises is the Grantor or tenants of the Grantor.

The Madison Athens-Clarke Oconee Regional Transpor-tation Study (MACORTS), the cooperative transportation planning body for the urbanized area which includes Athens-Clarke County, portions of southern Madison County and northern Oconee County, has been requested to amend the FY 2006 - 2008 Transportation Improvement Program (TIP) to include the changes listed below. This document outlines planned transportation improvements for the next six (6) years. This review meets the program of projects requirements as established by the FTA pursuant to 49 USC Section 5307(c).

Is my water safe?
Last year, as in years past, your tap water met all U.S. Environmental Protection Agency (EPA) and state drinking water health standards. Local Water vigilantly safeguards its water supplies and once again we are proud to report that our system has not violated a maximum contaminant level or any other water quality standard.
Do I Need to take special precautions?
Some people may be more vulnerable to contaminants in drinking water than the general population. Immuno-compromised persons such as persons with cancer undergoing chemotherapy, persons who have undergone organ transplants, people with HIV/AIDS or other immune system disorders, some elderly, and infants can be particularly at risk from infections. These people should seek advice about drinking water from their health care providers. EPA/Centers for Disease Control (CDC) guidelines on appropriate means to lessen the risk of infection by Cryptosporidium and other microbial contaminants are available from the Safe Water Drinking Hotline (800-426-4791).

The City of Carlton has (4) four deep wells. All four wells are in crystalline rock formation.

Why are there contaminants in my drinking water?
Drinking water, including bottled water, may reasonably be expected to contain at least small amounts of some contaminants. The presence of contaminants does not necessarily indicate that water poses a health risk. More information about contaminants and potential health effects can be obtained by calling the Environmental Protection Agency’s (EPA) Safe Drinking Water Hotline (800-426-4791). The sources of drinking water (both tap and bottled water) include rivers, lakes, streams, ponds, reservoirs, springs, and wells. In order to ensure that tap water is safe to drink, EPA prescribes regulations that limit the amount of certain contaminants in water provided by public water systems. Food and Drug Administration (FDA) regulations establish limits for contaminants in bottled water which must provide the same protection for public health.

Is my water safe?
Last year, as in years past, your tap water met all U.S. Environmental Protection Agency (EPA) and state drinking water health standards. Local Water vigilantly safeguards its water supplies and once again we are proud to report that our system has not violated a maximum contaminant level or any other water quality standard.
Do I Need to take special precautions?
Some people may be more vulnerable to contaminants in drinking water than the general population. Immuno-compromised persons such as persons with cancer undergoing chemotherapy, persons who have undergone organ transplants, people with HIV/AIDS or other immune system disorders, some elderly, and infants can be particularly at risk from infections. These people should seek advice about drinking water from their health care providers. EPA/Centers for Disease Control (CDC) guidelines on appropriate means to lessen the risk of infection by Cryptosporidium and other microbial contaminants are available from the Safe Water Drinking Hotline (800-426-4791).
Where does my water come from?
The City of Comer has a (3) three deep well water supply system. All three wells are in crystalline rock formations.
