Because of a default in the payment of the indebtedness secured by a Security Deed executed by Frank L. Wymbs to Wells Fargo Home Mortgage Inc., now Wells Fargo Bank, N.A. dated April 28, 2000, and recorded in Deed Book 264, Page 42, MADISON County Records, securing a Note in the original principal amount of $77,263.00, the holder thereof pursuant to said Deed and Note thereby secured has declared the entire amount of said indebtedness due and payable and, pursuant to the power of sale contained in said Deed, will on the first Tuesday, November 7, 2006, during the legal hours of sale, before the Courthouse door in said County, sell at public outcry to the highest bidder for cash, the property described in said Deed, to-wit:
All that tract or parcel of land situate, lying and being in the 382nd District, G.M., Madison County, Georgia designated as Tract 1, encompassing 5.289 Acres, more or less, as shown on a plat of survey entitled “Survey for Frank L. Wymbs”, prepared by Paul & Evans Land Surveying, Inc., certified by Thomas R. Paul, Georgia Registered Surveyors No. 2474, dated April 28, 2000 and being of record in the Office of the Clerk of the Superior Court for Madison County, Georgia in Plat Book B-46, Page 1, which plat and the recording thereof are by reference incorporated herein for a more complete and detailed description.
Also conveyed is the 20’ road easement as shown on the above referenced plat of survey for ingress and egress.
Said property is known as 276 South Creek Drive, Hull, GA 30646, together with all fixtures and personal property attached to and constituting a part of said property, if any.
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.
Notice has been given of intention to collect attorney’s fees in accordance with the terms of the Note secured by said Deed.
Said property will be sold as the property of Frank L. Wymbs, the property, to the best information, knowledge and belief of the undersigned, being presently in the possession of Frank L. Wymbs and Kathy D. Bolton, and the proceeds of said sale will be applied to the payment of said indebtedness and all the expenses of said sale, including attorney’s fees, all as provided in said Deed, and the balance, if any, will be distributed as provided by law.

Under and by virtue of the power of sale contained in that certain Commercial Construction Deed to Secure Debt Agreement from STONEMARK HOMES, LLC, a Georgia limited liability company (hereinafter referred to as “Borrower”) to COMMUNITY CAPITAL BANK, a Georgia banking corporation (hereinafter referred to as “Lender”), dated November 3, 2005, and recorded in Deed Book 00854, Pages 0121-0131, Madison County, Georgia Records (the “Security Deed”), the undersigned, as Attorney-in-Fact for Borrower, will sell at public outcry to the highest and best bidder for cash, between the legal hours of sale before the Courthouse door of Madison County, Georgia, on the first Tuesday in November, 2006 (November 7, 2006) the following described property, to wit (collectively, the “Property”):

Proposals
The Madison County Board of Commissioners is seeking proposals for the transportation and disposal of solid waste. The solid waste to be removed consists of waste collected at the County’s collection facility located at 2100 Colbert-Danielsville Road, Danielsville, GA 30633. All proposals should be based upon and incorporate the following criteria: (1) The successful proposer will be expected to enter into a contract for removal and disposal services, to begin November 1, 2006, and continue for an initial 3 year term ending October 31, 2009. The contract shall provide an option for the County to extend the contract annually, at its sole discretion, for successive one-year terms, up to a maximum of 7 such successive one-year terms. (2) The contract will provide that the proposer will remove waste from the County’s facility referenced above, and transport such waste to an approved landfill or other permanent disposal facility. (3) The proposer shall be compensated at a price per ton of waste removed and disposed of, and the proposal should state the bid in such terms. The County has scales installed at the above referenced facility, and measurements shall be made according to said scales. (4) In transporting and disposing of the waste, the proposer shall comply with all applicable laws and regulations. The contract shall indemnify the County, its agents and employees, and elected officials, for any violations of law or regulation or any other acts of the proposer or its employees or agents. (5) Partial loads removed shall be based on no more than a 17 ton minimum, and no partial loads shall be removed without the approval of the County’s Solid Waste Director. (6) The proposer shall provide a minimum of two trailers on site at all times, each trailer having a capacity of at least 22 tons. County employees or contractors will load the waste on to the trailers. Proposals
The Madison County Board of Commissioners is seeking proposals for the transportation and disposal of solid waste. The solid waste to be removed consists of waste collected at the County’s collection facility located at 2100 Colbert-Danielsville Road, Danielsville, GA 30633. All proposals should be based upon and incorporate the following criteria: (1) The successful proposer will be expected to enter into a contract for removal and disposal services, to begin November 1, 2006, and continue for an initial 3 year term ending October 31, 2009. The contract shall provide an option for the County to extend the contract annually, at its sole discretion, for successive one-year terms, up to a maximum of 7 such successive one-year terms. (2) The contract will provide that the proposer will remove waste from the County’s facility referenced above, and transport such waste to an approved landfill or other permanent disposal facility. (3) The proposer shall be compensated at a price per ton of waste removed and disposed of, and the proposal should state the bid in such terms. The County has scales installed at the above referenced facility, and measurements shall be made according to said scales. (4) In transporting and disposing of the waste, the proposer shall comply with all applicable laws and regulations. The contract shall indemnify the County, its agents and employees, and elected officials, for any violations of law or regulation or any other acts of the proposer or its employees or agents. (5) Partial loads removed shall be based on no more than a 17 ton minimum, and no partial loads shall be removed without the approval of the County’s Solid Waste Director. (6) The proposer shall provide a minimum of two trailers on site at all times, each trailer having a capacity of at least 22 tons. County employees or contractors will load the waste on to the trailers. (7) The proposer shall provide certificates of insurance evidencing general liability, motor vehicle liability, and worker’s compensation coverage, and shall add the County and its agents, employees, and elected officials as additional insureds upon request. (8) The County’s facility keeps regular operating hours of 8:00 A.M. to 4:30 P.M., Monday through Saturday. (9) Proposer shall stand ready at all times during the contract term to produce records and accountings related to its removal and disposal of the County’s solid waste, upon the County’s request. (10) The proposer shall be responsible for securing and tarping loads during transport and will be responsible for any garbage or debris blown from vehicles or trailers during transport. (11) The successful proposal shall be expected to execute a contract incorporating the terms described herein and other standard terms and conditions. Proposals will be accepted no later than 12:00 Noon, October 23, 2006, and must be submitted in a sealed envelope with “Sealed Proposal for Solid Waste Disposal” to County Clerk Morris Fortson, by one of the following methods: 1) hand delivery to the County Clerk’s Office located at 91 Albany Ave., Danielsville, GA 30633 or Via United States Mail to Madison County Board of Commissioners, P O Box 147, Danielsville, GA 30633, Attention Morris Fortson, County Clerk.
