Because of a default in the payment of the indebtedness secured by a Security Deed executed by Frank L. Wymbs to Wells Fargo Home Mortgage Inc., now Wells Fargo Bank, N.A. dated April 28, 2000, and recorded in Deed Book 264, Page 42, MADISON County Records, securing a Note in the original principal amount of $77,263.00, the holder thereof pursuant to said Deed and Note thereby secured has declared the entire amount of said indebtedness due and payable and, pursuant to the power of sale contained in said Deed, will on the first Tuesday, November 7, 2006, during the legal hours of sale, before the Courthouse door in said County, sell at public outcry to the highest bidder for cash, the property described in said Deed, to-wit:
All that tract or parcel of land situate, lying and being in the 382nd District, G.M., Madison County, Georgia designated as Tract 1, encompassing 5.289 Acres, more or less, as shown on a plat of survey entitled “Survey for Frank L. Wymbs”, prepared by Paul & Evans Land Surveying, Inc., certified by Thomas R. Paul, Georgia Registered Surveyors No. 2474, dated April 28, 2000 and being of record in the Office of the Clerk of the Superior Court for Madison County, Georgia in Plat Book B-46, Page 1, which plat and the recording thereof are by reference incorporated herein for a more complete and detailed description.
Also conveyed is the 20’ road easement as shown on the above referenced plat of survey for ingress and egress.
Said property is known as 276 South Creek Drive, Hull, GA 30646, together with all fixtures and personal property attached to and constituting a part of said property, if any.
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.
Notice has been given of intention to collect attorney’s fees in accordance with the terms of the Note secured by said Deed.
Said property will be sold as the property of Frank L. Wymbs, the property, to the best information, knowledge and belief of the undersigned, being presently in the possession of Frank L. Wymbs and Kathy D. Bolton, and the proceeds of said sale will be applied to the payment of said indebtedness and all the expenses of said sale, including attorney’s fees, all as provided in said Deed, and the balance, if any, will be distributed as provided by law.

Under and by virtue of the power of sale contained in that certain Commercial Construction Deed to Secure Debt Agreement from STONEMARK HOMES, LLC, a Georgia limited liability company (hereinafter referred to as “Borrower”) to COMMUNITY CAPITAL BANK, a Georgia banking corporation (hereinafter referred to as “Lender”), dated November 3, 2005, and recorded in Deed Book 00854, Pages 0121-0131, Madison County, Georgia Records (the “Security Deed”), the undersigned, as Attorney-in-Fact for Borrower, will sell at public outcry to the highest and best bidder for cash, between the legal hours of sale before the Courthouse door of Madison County, Georgia, on the first Tuesday in November, 2006 (November 7, 2006) the following described property, to wit (collectively, the “Property”):

The debt remaining in default and unpaid, this sale will be for the purpose of satisfying the principal and interest due, amounts, if any, expended by Lender to protect its interest in the Property, and all expenses of this sale, including, without limitation, attorneys’ fees.
The Property will be sold subject to outstanding ad valorem taxes and/or assessments, and superior easements, restrictions and rights-of-way and other superior matters of record, if any. The undersigned will execute a deed to the purchaser at the sale as provided in the aforesaid Security Deed.

This proposal provides several limitations with respect to the exercise of the power of eminent domain and the taking of private property for public purposes. The proposal provides that any taking of private property for redevelopment purposes must be approved by vote of the appropriate elected city or county governing authority. The proposal provides that any taking of private property for redevelopment purposes must be for a public use as defined by general state law. The proposal provides that the exercise of eminent domain by cities and counties can be restricted by general state law and that any exercise of eminent domain by a nonelected housing or development authority must be approved by vote of the appropriate elected city or county governing authority.

This proposal authorizes the General Assembly to provide for special motor vehicle license plates to be made available for optional purchase. The General Assembly is authorized to dedicate some or all revenue from the sale of the special plates for programs relating to the subject of the special plate. The dedicated revenue may go to an agency, a fund, or a nonprofit corporation and may be for the ultimate use of a nonprofit corporation if found to benefit both the state and the nonprofit corporation. Such dedicated revenue shall not be paid into or lapse to the general fund of the state treasury. Any law of this type will have to be passed by a two thirds’ majority in both the Senate and House of Representatives.

This Act expands the existing ad valorem tax exemption for certain veterans organizations to include property which is owned by and used exclusively by any veterans organization which is qualified as a nonprofit organization under Section 501(c)(3) of the Internal Revenue Code of 1986, as amended, and which has been organized for the purpose of refurbishing and operating historic military aircraft acquired from the federal government and other sources, making such aircraft airworthy, and putting such aircraft on display to the public for educational purposes.
If approved by a majority of the voters, the Act becomes effective on January 1, 2007, and applies to all tax years beginning on or after that date.

To expand the ad valorem tax exemption for property of charitable institutions.

Shall the Act be approved which grants an exception from ad valorem taxation on property owned by a charitable institution which generates income when that income is used exclusively for the operation of such charitable institution?”
This section of this Act expands the ad valorem tax exemption for property of charitable institutions so that the exemption will apply to real estate or buildings which are owned by a charitable institution that is exempt from taxation under Section 501(c)(3) of the federal Internal Revenue Code and used by such charitable institution for the purpose of securing income so long as such income is used exclusively for the operation of that charitable institution.
If approved by a majority of the voters, this section of the Act becomes effective on January 1, 2007, and applies to all tax years beginning on or after that date.

To provide a homestead exemption to certain residents who are senior citizens with respect to state ad valorem taxes.

This section of this Act grants an exemption from all state ad valorem property taxes to the homestead of a person who is 65 years of age or over, to include the primary residence and not more than ten contiguous acres of land. This exemption applies to state ad valorem taxes but not those levied by local governments.
If approved by a majority of the voters, this section of the Act becomes effective on January 1, 2007, and applies to all tax years beginning on or after that date.

To provide a homestead exemption for the surviving spouse of a peace officer or firefighter killed in the line of duty.

This section of this Act provides that the unremarried surviving spouse of a peace officer or firefighter who was killed in the line of duty shall be entitled to a total exemption of the homestead from all ad valorem taxes.
If approved by a majority of the voters, this section of the Act becomes effective on January 1, 2007, and applies to all tax years beginning on or after that date.

To provide that a surviving spouse shall be entitled to a continuation of the base year value under a base year assessed value homestead exemption.

Shall the Act be approved which provides that, with respect to base year assessed value homestead exemptions, the surviving spouse of a deceased spouse who has been granted such a homestead exemption, shall receive that exemption at the same base year valuation that applied to the deceased spouse so long as that surviving spouse continues to occupy the home as a residence and homestead?”
This section of this Act relates to base year assessed value homestead exemptions, also known as homestead freeze exemptions. These are exemptions which increase so long as a person owns a homestead with the effect that the owner does not have an increase in tax liability because of increases in the assessed value of the homestead. This section of the Act provides that when a property owner with an existing base year assessed value homestead exemption dies, his or her surviving spouse who otherwise meets the requirements for the exemption shall be entitled to continue the exemption with the previously established base year amount. The effect is that the surviving spouse will not incur increased tax liability due to increases in assessed value since the exemption was granted to the deceased spouse.
If approved by a majority of the voters, this section of the Act becomes effective on January 1, 2007, and applies to all tax years beginning on or after that date.

The Madison County School District, Department of Student Services, announces its intention to destroy specific data. Records will be destroyed that were collected, maintained, or used in the prevention of a free appropriate public education for students with disabilities in Madison County Schools. This notice is in compliance with the system’s comprehensive plan for special education required by I.D.E.A.
Records on students who received special education services for students with disabilities and became twenty-seven (27) years old or older between June 1, 2005, and June 1, 2006, or deceased between June 1, 2005, and June 1, 2006, are no longer needed for educational planning purposes. These records may be needed by the student or parent for Social Security or other reasons. The system plans to destroy these records on November 30, 2006, unless there has been a request for a due process hearing, under P.L. 94-142 or I.D.E.A. or a complaint filed with the Office of Civil Rights, under Section 504 of the Rehabilitation Act of 1973.
If you, as the student or parents of the student, desire copies of these records prior to destruction, contact the office of the Student Services at (706) 788-3428. You will be required to produce identification or provide verification data.
