Because of the default in the payment of a note in the original principal amount of $67,000.00 executed by RICKY A. BOLTON and SHEILA M. BOLTON in favor of NORTH GEORGIA FARM CREDIT ACA, on July 22, 1994, secured by a deed to secure debt executed by RICKY A. BOLTON and SHEILA M. BOLTON to NORTH GEORGIA FARM CREDIT, ACA, dated July 22, 1994, recorded in the Clerk’s Office of the Superior Court of Jackson County, Georgia, in Deed Book 14-A, Page 252-254 the undersigned has declared the full unpaid amount of the indebtedness secured by said deed due and payable, and acting under the power of sale contained in said deed, for the purpose of paying said indebtedness, will on the first Tuesday in OCTOBER, 2006, during the legal hours of sale at the Courthouse in Jackson County, Georgia, sell at public outcry to the highest bidder for cash, the land and all improvements thereon the property described as follows:
All that tract or parcel of land lying and being in the 253rd G.M.D. Jackson County, Georgia, and containing 16.21 acres, more or less, as shown by plat and survey of same of Venable & Associates, Inc., Surveyors, dated November 15, 1989, said plat being recorded in the Office of the Clerk of superior Court of Jackson County, Georgia, in Plat Book 33, Page 52. Bounded according to said plat on the North by lands of Mrs. Willie R. Hanley, on the East by GA. Highway 334 right of way, on the South by lands of Sid H. Dunken, and on the West by land of Doug Makemson. Said plat and the description thereof being incorporated herein by reference and made a part of this description. Subject to existing easements and rights of way for public roads and utilities now in use.
This sale will be held subject to any unpaid taxes or other assessments, which may be liens against said property, and all easements and covenants of record.
The indebtedness remaining in default, the sale will be made for the purpose of applying proceeds thereof to the payment of the indebtedness secured by the deeds to secure debt, accrued interest and expenses of the sale and other sums secured by the deeds to secure debt and the remainder if any shall be applied as permitted by law.

On Tuesday October 10, 2006, at 4:00 PM, the Georgia Department of Transportation will hold a Public Information Open House concerning Projects NH-IM-85-2(168), (169), (170) in Jackson and Banks Counties. The Open House will be held at the Commerce Civic Center, 110 State Street, Commerce, Georgia 30529.
Project NH-IM-85-2(168), (169), (170), Jackson and Banks Counties is a proposal to widen and reconstruct I-85 from just north of SR 11 in Jackson County to just north of SR 15/US 441 in Banks County. The existing four-lane Interstate highway would be widened to six lanes. The existing I-85 bridges over the North Oconee River and Ridgeway Church Road would be widened to accommodate the additional lanes. The proposed projects would also include lengthening the interchange ramps at SR 82, SR 98/North Elm Street and SR 15/US 441. All construction would be conducted within the existing right-of-way.
The purpose of this Open House is to provide the public with an opportunity to view the proposed project, ask questions, and to comment on the proposal.
The Open House will be conducted between the hours of 4:00 p.m. and 7:00 p.m. The public is invited to attend anytime during these hours and the Open House will be informal. There will be no formal presentation.
Written statements will be accepted concerning this project until October 24, 2006.

Changes are Made in Determinations of Base Flood Elevations for the Unincorporated Areas of Jackson County, Georgia, Under the National Flood Insurance Program
On November 16, 1990, the Department of Homeland Security’s Federal Emergency Management Agency identified Special Flood Hazard Areas (SFHAs) in the unincorporated areas of Jackson County, Georgia, through issuance of a Flood Insurance Rate Map (FIRM). The Mitigation Division has determined that establishment of elevations of the flood having a 1-percent chance of being equaled or exceeded in any given year (base flood) for certain locations in this community is appropriate. The modified Base Flood Elevations (BFEs) revise the FIRM for the community.
The changes are being made pursuant to Section 206 of the Flood Disaster Protection Act of 1973 (Public Law 93-234) and are in accordance with the National Flood Insurance Act of 1968, as amended (Title XIII of the Housing and Urban Development Act of 1968, Public Law 90-448), 42 U.S.C. 4001-4128, and 44 CFR Part 65.
Hydrologic and hydraulic analyses were performed to incorporate new detailed data along Walnut Creek from just upstream to approximately 6,100 feet upstream of State Route 60. This has resulted in establishment of new BFEs and increases and decreases in SFHA width for Walnut Creek. The table below indicates existing and modified BFEs for selected locations along the affected lengths of the flooding source(s) cited above.

Under the above-mentioned Acts of 1968 and 1973, the Mitigation Division must develop criteria for floodplain management. To participate in the National Flood Insurance Program (NFIP), the community must use the modified BFEs to administer the floodplain management measures of the NFIP. These modified BFEs will also be used to calculate the appropriate flood insurance premium rates for new buildings and their contents and for the second layer of insurance on existing buildings and contents.
Upon the second publication of notice of these changes in this newspaper, any person has 90 days in which he or she can request, through the Chief Executive Officer of the community, that the Mitigation Division reconsider the determination. Any request for reconsideration must be based on knowledge of changed conditions or new scientific or technical data. All interested parties are on notice that until the 90-day period elapses, the Mitigation Division’s determination to modify the BFEs may itself be changed.

Under and by virtue of the power of sale contained in that certain Deed to Secure Debt from DEAN SOLOMON (hereinafter referred to as “Borrower”) to MAIN STREET BANK (hereinafter referred to as “Lender”), dated May 6, 2004, and recorded in Deed Book 34-W, Page 106, et. seq., Jackson County, Georgia Records, as modified by Modification of Deed to Secure Debt dated August 5, 2005, and recorded in Deed Book 40-F, Page 226, aforesaid records, and as modified by Modification of Deed to Secure Debt dated February 14, 2006, and recorded in Deed Book 42-V, Page 478, aforesaid records (the “Security Deed”), the undersigned, as Attorney-in-Fact for Borrower, will sell at public outcry to the highest and best bidder for cash, between the legal hours of sale before the Courthouse door of Jackson County, Georgia, on the first Tuesday in October, 2006 (October 3, 2006), the following described property, to wit:
ALL THAT TRACT OR PARCEL OF LAND lying and being in the 245th and 248th District, G.M., Jackson County, Georgia, being Lot 57, Pod E, of Traditions of Braselton, Phase I, as shown on a plat of survey recorded in Plat Book 62, Page 258, in the Office of the Clerk of the Superior Court of Jackson County, Georgia, which recorded plat is hereby incorporated herein by reference and made a part of this description, being improved property with a street address of 3456 River Birch Loop, according to the present system of numbering houses in Jackson County, Georgia.
Said Security Deed was given to secure a Multipurpose Note and Security Agreement dated May 6, 2004, in the original principal amount of TWO HUNDRED NINETY-THREE THOUSAND AND NO/HUNDREDTHS DOLLARS ($293,000.00), as renewed and increased by Universal Note and Security Agreement dated June 24, 2005 in the original principal amount of TWO HUNDRED NINETY-THREE THOUSAND TWELVE AND NO/HUNDREDTHS DOLLARS ($293,012.00), as renewed and increased by Universal Note and Security Agreement dated August 5, 2005 in the original principal amount of THREE HUNDRED TWO THOUSAND AND NO/HUNDREDTHS DOLLARS ($302,000.00), and as modified by Commercial Debt Modification Agreement dated February 14, 2006 (the “Promissory Note”), with interest thereon as provided in said Promissory Note until paid.
On account of defaults in the terms of the Promissory Note, the Security Deed and other loan documents, including Borrower’s failure to pay monthly installments as due and when due, Lender, the present holder of said Security Deed and Promissory Note, has declared the entire unpaid principal balance of all obligations secured by said Security Deed, including interest to date of sale, to be due and payable immediately.
The debt remaining in default and unpaid, this sale will be for the purpose of satisfying the principal and interest due, amounts, if any, expended by Lender to protect its interest in the Property, and all expenses of this sale, including, without limitation, attorneys’ fees.
The Property will be sold subject to outstanding ad valorem taxes and/or assessments, and superior easements, restrictions and rights-of-way and other superior matters of record, if any. The undersigned will execute a deed to the purchaser at the sale as provided in the aforesaid Security Deed.
To the best knowledge and belief of Lender, the equitable title to the Property is vested in Borrower, and the party in possession of the Property is Borrower.
