Under and by virtue of the power of sale contained in that certain Deed to Secure Debt from Larry D. Barber and Joley C. Barber to Mortgage Electronic Registration Systems, Inc. dated 06/23/2006, and recorded in Deed Book 923, Page 185, Madison County Records, the undersigned will sell at public outcry to the highest bidder for cash before the Courthouse door in said County, during the legal hours of sale, on the first Tuesday in May, 2007, by Mortgage Electronic Registration Systems, Inc., as Attorney-in-Fact for Larry D. Barber and Joley C. Barber the following described property:
All that lot or parcel of land, together with all improvements thereon, situate, lying and being in the 383rd District, G.M., Madison County, Georgia, and being more particularly shown and described according to a plat of survey entitled “Survey for: Larry D. Barber & Joley C. Barber”, prepared by Paul & Evans, Gregory J. Evans, R.L.S., dated July 29, 1992, recorded in Plat Book 28, Page 548, Madison County, Georgia, Public Records, which said plat of survey and the record thereof are hereby incorporated into this description and made a part hereof by reference thereto.
Property known as: 255 Seagraves Road, Hull, GA 30646.
The indebtedness secured by said Deed to Secure Debt having been declared due and payable because of default in the payment of the indebtedness secured thereby, this sale will be made for the purposes of paying the same and all expenses of sale, including attorney’s fees, (notice having been given as provided by law).
The property will be sold as the property of The Aforesaid Grantors subject to the following:
(1) all prior restrictive covenants, easements, rights-of-way or encumbrances; (2) all valid zoning ordinances; (3) matters which would be disclosed by an accurate survey of the property; (4) the outstanding ad valorem taxes and assessments, if any; (5) unpaid water and sewage bills, that constitute liens against the property, whether due and payable or not yet due and payable; and (6) matters of record superior to the security deed first set out above.

The date of location approval is January 22, 2007.
Project located within: Madison County, Georgia Militia Districts 205 and 382
Project begins approximately 1,800 feet east of SR 72/SR 172 intersection, extending eastward to the west city limits of Comer, Georgia. The project follows along existing SR 72 with widening to the north side of the existing highway.
Proposed project is 2.67-mile, two to four-lane highway widening project with a raised concrete median for the first mile and a depressed grass median for the remainder. Rural shoulders are proposed for the entire project. The Project plans include bike lanes and both the replacement of the existing bridge and a new parallel bridge over South Fork Broad River. The project parallels an active CSX Railroad line and includes two side streets with railroad grade crossings. The project is part of the Governor’s Road Improvement Program (GRIP). It has been proposed to stimulate economic growth throughout the state.
Drawings or maps or plats of the proposed project, as approved, are on file and are available for public inspection at the Georgia Department of Transportation.
