Under and by virtue of the Power of Sale contained in that certain Deed to Secure Debt and Security Agreement dated March 15, 2005, from Waynemark Group, LLC, (“Grantor”) to The Peachtree Bank (“Grantee”), recorded on March 21, 2005, in Deed Book 38-C, Page 435, Jackson County Georgia, Records, as modified by that certain Modification of Deed to Secure Debt and Security Agreement and Assignment of Leases and Rents dated September 15, 2006, filed and recorded October 3, 2006, in Deed Book 45-T, Page 215, aforementioned records (as modified the “Security Deed”), conveying the after-described property to secure that certain (1) Universal Note dated September 15, 2006, from Jordan Coach, LLC to Grantee, in the original principal amount of $600,000.00 with interest thereon set forth therein (the “First Note”) and (2) Universal Note dated September 15, 2006 from Jordan Coach, LLC to Grantee in the original principal amount $400,000.00 with interest thereon set forth therein (the “Second Note”) (collectively referred to as the “Notes”), there will be sold at public outcry to the highest bidder for cash before the courthouse door of Jackson County, Georgia, within the legal hours of sale on the first Tuesday in July, 2007, the following described properties:
All that tract or parcel of land lying and being in G.M.D. 455, Jackson County, Georgia, depicted as Tract No. 3 containing 7.001 acres according to a plat of survey for Wild Ride, LLC, by Brian Slate, Georgia Registered Land Surveyor No. 2629, dated December 16, 2004, as revised January 12, 2005 and January 24, 2005, and being more particularly described as follows:
Begin at an iron pin on the easterly right of way of Horace Head Road (100 foot right-of-way at this point) lying north 10 degrees 43 minutes 10 seconds east 120 feet from an iron pin located at the northeasterly point of intersection of said right-of-way with the northerly right-of-way of Georgia State Route 82 (which has a 130 foot right-of-way at this point). From said point of beginning, continue along said easterly right-of-way of Horace Head Road north 10 degrees 43 minutes 10 seconds east 429.20 feet to an iron pin located at the point at which Horace Head Road turns in an easterly direction; continue thence along the southerly right-of-way of Horace Head Road, (which has an 80 foot right-of-way at this point) north 87 degrees 15 minutes 02 seconds east 1254.10 feet to an iron pin; thence leaving said right of way run thence south 65 degrees 27 minutes 31 seconds west 751.55 feet to an iron pin; run thence south 75 degrees 20 minutes 32 seconds west 670.66 feet to an iron pin and the point of beginning.

All that tract or parcel of land lying and being in G.M.D. 455 of Jackson County, Georgia, being designated as Tract No. 2 and containing 2.000 acres according to a survey for Wildride, LLC prepared by Slate & Assoc., Inc. by Brian Slate (GRLS No. 2629), dated December 16, 2004, as last revised January 24,2005, and being more particularly described according to said survey as follows:
To locate the true place or point of beginning, commence at a point located at the intersection of the northwesterly right-of-way line of Horace Head Road (100’ R/W) and the northerly right-of-way line of S.R. 82 (A/K/A Dry Pond Road) (130’ R/W), and run thence along said right of way line of Horace Head Road north 10 degrees 43 minutes 11 seconds east a distance of 528.99 feet to a point marked by an iron pin set, said point being the true place or point of beginning.
From the true place or point of beginning as thus established, and leaving said right of way line, run thence north 71 degrees 43 minutes 03 seconds west a distance of 567.19 feet to a point located on the right of way line of Interstate 85 (exit ramp) to an iron pin set; run thence along the aforesaid right-of-way line along the arc of a curve to the right a distance of 313.72 feet to a concrete monument found, said arc having a radius of 1,080.90 feet and being subtended by a chord bearing and distance of north 44 degrees 07 minutes 17 seconds east 312.62; leaving the aforesaid right-of-way line, run thence south 30 degrees 35 minutes 36 seconds east a distance of 308.59 feet to an iron pin found; run thence north 80 degrees 46 minutes 15 seconds east a distance of 198.33 feet to an iron pin set located on the aforesaid right-of-way line south 10 degrees 43 minutes 11 seconds west a distance of 171.52 feet to a point marked by an iron pin set, said point being the true place or point of beginning.
The indebtedness secured by said Security Deed has been and is hereby declared due and payable because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Notes. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney’s fees (notice of intent to collect attorney’s fees having been given as provided by law).
The properties will be sold for cash or certified funds and subject to any and all matters of record superior to said Security Deed, outstanding ad valorem taxes, any matters which might be disclosed by an accurate survey and inspection of the properties, zoning ordinances, restrictions, covenants, and easements against the properties, if any. The sale will be conducted as set forth herein subject to (1) confirmation prior to the sale that the sale is not prohibited under the U.S. Bankruptcy Code and (2) final confirmation and audit prior to the sale of the status of the loan with the holder of the Security Deeds.
Grantee reserves the right to sell the properties in one parcel or as an entirety, or in such parcels as Grantee may elect, as permitted in the Security Deed.
