The said named persons and any and all other persons known and unknown claiming any right, title, power, interest, ownership, equity, claim or demand in and to the lands hereinafter described, and all occupants, tenants, lessees, licensees and all holders, owners and users of ways and easements in, across, over and under said land are hereby notified, under the provisions of the Official Code of Georgia Annotated Sections 32-3-4 through 32-3-19, providing for the exercise of the power of eminent domain by the State of Georgia, or any of its subdivisions, or by any county of such State, as follows:
That the above stated case, being a condemnation in rem against the property hereinafter described, was filed in said Court on the 15 day of April, 2008. TO ANDREW ENTREKIN, RODNEY SHANNON, JASON TREADWELL, and any other alleged putative biological father of the subject child; and anyone claiming to have a parental interest in the minor child of the sex and age identified above. The mother of said child is Misty Phillips.
YOU ARE HEREBY NOTIFIED that the above styled action seeking an order terminating parental rights to the above listed child was filed against you in the Madison County Juvenile Court on April 11, 2008, and an Order for Service by Publication was entered by the Madison County Juvenile Court on April 18, 2008.
YOU ARE HEREBY COMMANDED AND REQUIRED to appear before the Juvenile Court of Madison County, Georgia, on June 13, 2008, at 8:30 o’clock a.m. for a hearing to be held at the Franklin County Courthouse in Carnesville, Georgia. The hearing is for the purpose of determining whether or not your parental rights to the above listed child should be terminated.
A copy of the Petition for Termination of Parental Rights may be obtained from the Clerk of the Juvenile Court of Madison County at 91 Albany Avenue, P.O. Box 247, Danielsville, Georgia 30633, during regular business hours, Monday through Friday, 8:00 a.m. until 5:00 p.m., exclusive of holidays. A free copy shall be available to the parents. Upon request, the copy will be mailed to the requester. The child is in the present physical custody of Madison County Department of Family and Children Services.
The general nature of the allegations is that all parental rights to the above listed child should be terminated. Said order terminating parental rights, pursuant to O.C.G.A. ‘15-11-93, is without limit as to duration and terminates all of the parents’ rights and obligations with respect to the child and all rights and obligations of the child to the parent arising from the parental relationship, including rights of inheritance. The parent is not thereafter entitled to notice of proceedings for the adoption of the child by another, nor has the parent any right to object to the adoption or otherwise to participate in the proceedings.
YOU ARE FURTHER NOTIFIED that you lose all rights to the child and will neither receive notice nor be entitled to object to the termination of your parental rights to the above named child unless, within thirty (30) days of your receipt of this notice, you file:
(1) A petition to legitimate the children pursuant to O.C.G.A. ‘15-11-96 et seq.; and
(2) Provide notice of the filing of the petition to legitimate with the Court in which this action is pending.
YOU ARE FURTHER NOTIFIED that while responsive pleadings, other than the petition to legitimate, are not mandatory, they are permissible and you are encouraged to file with the clerk of this court and serve upon Petitioner’s attorney, Chad A. Hunt, P.O. Box 51, Crawford, Georgia 30630, an answer or other responsive pleading within thirty (30) days of your receipt of this notice.
All concerned parties are informed that they are entitled to have an attorney represent them, and if a party is unable, without undue financial hardship, to employ counsel, the Court will appoint counsel at no cost to the party.
