By order for service by publication dated the 7th day of October,
1999, you are hereby notified that on the 7th day of October,
1999, the Lumpkin County Department of Family and Children Services
filed a petition for Termination of Parental Rights against you
as to the above-named child and the Court found it to be in the
child's best interest that the petition be filed. This notice
is being sent to you pursuant to the provisions of O.C.G.A. §15-11-83.
The Petition is for the purpose of terminating your parental
rights to the above-named child.
Pursuant to O.C.G.A. §15-11-83(e), you are advised that
you will lose all rights to the above-named child and will not
be entitled to object to the termination of your parental rights
to the child unless within thirty (30) days of the receipt of
this notice you file a petition to legitimate the child pursuant
to O.C.G.A. §19-7-22 and file notice of the filing of the
petition to legitimate in the court in Juvenile Court of Lumpkin
County. If you fail to file a Petition to Legitimate within thirty
(30) days of your receipt of this notice or fail to prosecute
it to its final judgment, you will lose all rights to the child
and the Court shall enter an order terminating all your rights
to the child and you may not thereafter object to the termination
of your rights to the child.
Pursuant to the provisions of O.C.G.A. §15-11-80, the effect
of an order terminating your parental rights under this article
is without limit as to duration and terminates all your rights
and obligations with respect to the child and all rights and
obligations of the child to you, arising from the parental relationship,
including rights of inheritance. You are not thereafter entitled
to notice of proceedings for the adoption of the child by another,
nor do you have any right to object to the adoption or otherwise
participate in the proceedings.
In the event that you are unable to employ counsel, a right that
you are entitled to, and if indigent as that term is defined
under the provisions of O.C.G.A. §15-11-30, you must immediately
contact the Lumpkin County Courthouse and request the appointment
of counsel to represent you in these proceedings.
The Court will conduct the hearing on the Petition for Termination
on the 27th day of January, 2000, at 9:00 a.m., in the Juvenile
Court of Lumpkin County, Lumpkin County Courthouse, Dahlonega,
Georgia.

The said named persons and any and all other persons known and
unknown claiming any right, title, power, interest, ownership,
equity, claim or demand in and to the lands hereinafter described,
and all occupants, tenants, lessees, licensees and all holders,
owners and users of ways and easements in, across, over and under
said land are hereby notified, under the provisions of the Official
Code of Georgia Annotated Sections 32-3-4 thru 32-3-19, providing
for the exercise of the power of eminent domain by the State
of Georgia, or any of its subdivisions, or by any county of such

than 60 days from filing of the Declaration of Taking.
That in accordance with the Official Code of Georgia Annotated

the Declaration of Taking and deposited in Court, such person

A temporary easement is condemned for the right to construct
a sediment basin and ditch. The easement will begin on the initiation
of construction and will continue until March 31, 2003, at which
time said easement will expire. Said easement is shown colored
green on the attached plats marked Annex 1-A.
Temporary easements are condemned for the right to construct
fencing. Said easements will expire on March 31, 2003 and are
shown colored orange on the above mentioned plats. Upon completion
of the project, the condemnees shall have the right to use the
easement areas in accordance with the applicable zoning restrictions,
and the condemnor will cease maintenance of the easement areas.
Said easements may also be used temporarily to remove buildings.
Temporary work easements are condemned for the right to enter
upon the adjacent lands not condemned for the limited purpose
of effectuating removal of two buildings acquired herein; and
the work of removing these buildings shall be done in an expeditious
manner with as little disruption to the remainder as is practicable
under the circumstance. The easements will begin on the date
possession is granted and continue until the buildings are removed
or until March 31, 2003, whichever comes first, at which time

We're pleased to present to you this year's Annual Drinking Water
Quality Report. This report is designed to inform you about the
quality water and services we deliver to you every day. Our constant
goal is to provide you with a safe and dependable supply of drinking
water. We want you to understand the efforts we make to continually
improve the water treatment process and protect our water resources.
We are committed to ensuring the quality of your water.
Where Our Water
Comes From
The Nicholson Water Authority gets its water from six groundwater
wells. These wells are approximately 500 feet deep. These wells
are located at various locations throughout our water system.
Each well site location, as well as water quality has met EPD
standards. Our water source is commonly called the Piedmont Aquifer
and it provides ample volume of water for our community. Beneath
the surface of the land lies a tremendous resource that many
of US depend on for our very existence, yet often take for granted.
This precious resource is groundwater. Georgia's ground-water
reservoirs (aquifers) provide water for almost half the State's
population and about 90% of its rural residents. The characteristics
of this water source do not change as rapid as surface water.
Ground-water from these aquifers usually require no surface treatment,
except for chlorination to prevent bacteria in system distribution.
(For a diagram of the Piedmont Aquifer, please see attached Exhibit
"A".)
Drinking Water Meets State and Federal Regulations
The Nicholson Water Authority's Drinking Water meets and/or exceeds
the regulations as set by the State and Federal Government. Included
in this report is important information in regards to your water
quality, where it comes from, the parameters of detected contaminants
and how our water compares to those parameters as set by regulatory
agencies. The contaminants that were detected in our drinking
water are listed in this report and an explanation is given as
to why they were found.
FOR YOUR INFORMATION
Source Water...Where It Comes From
The Sources of Drinking Water (both tap water and bottled water)
includes rivers, lakes, streams, ponds, reservoirs, springs,
and wells. As water travels over the surfaces of the land or
through the ground, it dissolves naturally occurring minerals
and, in some cases, radioactive material, and can pick up substances
resulting from the presence of animals and/or human activity.
All Drinking Water, Including Bottled Water, may reasonably be
expected to contain at least small amounts of some contaminants.
The presence of some contaminants does not necessarily indicate
that the drinking water poses a health risk. More information
can be obtained by calling the Environmental Protection Agency's
Safe Drinking Water Hotline at 1-800-426-4791.
Some People May Be More Vulnerable to contaminants in drinking
water than the general population. Immuno-compromised persons
such as persons with cancer undergoing chemotherapy, persons
who have undergone organ transplants, people with HIV/AIDS or
other immune system disorders, some elderly, and infants can
be particularly at risk from infections. These people should
seek advice about drinking water from their health care providers.
EPA/CDC guidelines on appropriate means to lessen the risk of
infection by cryptosporidium and other microbiological contaminants
are available from the Safe Drinking Water Hotline (800-426-4791).
Contaminants That May Be Present In Source Water Before Treatment
Includes:
*Microbial Contaminants, such as viruses and bacteria, may come
from sewerage treatment plants, septic systems, agricultural
livestock operations, and wildlife.
*Inorganic Contaminants, such as salts and metals, which can
be naturally occurring or result from urban runoff, industrial
or domestic wastewater discharges, oil and gas production, mining
or farming.
*Pesticides and Herbicides may come from a variety of sources
such as agriculture, urban stormwater runoff, and septic systems.
*Organic Chemicals Contaminants, including synthetic and volatile
organic chemicals, which are by-products of industrial processes
and petroleum productions, and can also come from gas stations,
urban stormwater runoff, and septic systems.
*Radioactive Contamin-ants, which can be naturally occurring
or be the results of oil and gas production and mining activities.
In order to ensure that tap water is safe to drink, samples are
taken, laboratory test are conducted and EPA prescribes regulations
that govern these activities and limit the amount of certain
contaminants in water provided by public water systems. In 1998,
The Nicholson Water Authority conducted over 200 laboratory tests
for more than 80 water parameters to insure the water we provide
our customers is safe. The Food and Drug Administration regulations
establish limits for the contaminants in bottled water, which
must provide the same protection for the public health.
Definitions, Terms
& Abbreviations:
(ppb) =Parts Per Billion: One part per billion is equivalent
to one minute in 2,000 years or one penny in ten million dollars.
(ppm) =Parts Per Million: One part per million is equivalent
to one minute in 2 years or one penny in ten thousand dollars.
(MCL) =Maximum Contaminant Level: The highest level of a contaminant
that is allowed in drinking water. "MCL are set as close
to the MCLG" as feasible using the best treatment technology.
(MCLG) =Maximum Contaminant Level Goal: The level of a contaminant
in drinking water below which there is no known or expected risk
to health. MCLG's allow for a margin of safety.
(AL) =Action Level: The concentration of a contaminant which,
when exceeded, triggers treatment or other requirements which
a system must follow.
(n/a) =not applicable
(NWA) = Nicholson Water Authority
Water Quality Data
The following tables list all the drinking water contaminants
that were detected in our drinking water during the l998 calendar
year. The presence of these contaminants in the water does not
necessarily indicate that the water poses a health risk. Unless
otherwise noted, the data presented in these tables is from the
testing done January 1 through December 31, 1998.
MICROBIOLOGICAL
CONTAMINANTS
Contaminant, Total Coliform (1 sample positive/23 negative);
Violation, Yes; Level Detected, 100; Unit Measurement, ml; MCLG,
0; MCL, presence of Coliform Bacteria in 5% of monthly samples;
Likely Source of Contamination, naturally present in environment.
*Total Coliform. Coliforms are bacteria that are naturally present
in the environment and are used as an indicator that other, potentially
harmful, bacteria may be present. Coliforms were found in more
samples than allowed and this was a warning of potential problems.
Total Coliform: The Total Coliform Rule requires water systems
to meet a stricter limit for coliform bacteria. Coliform bacteria
are usually harmless, but their presence in water can be an indication
of disease-causing bacteria. When coliform bacteria are found,
special follow-up tests are done to determine if harmful bacteria
are present in the water supply. If this limit is exceeded the
water supplier must notify the public by newspaper, television
or radio. To comply with the stricter regulation, we have increased
the average amount of chlorine in the distribution system.
INORGANIC
CONTAMINANTS
Contaminant, Nitrate (As Nitrogen); Violation, Yes; Level, 5.0;
Unit, ppm; MCLG, 10; MCL, 10; Likely Source of Contamination,
runoff from fertilizer use; leaching from septic tanks, sewage;
erosion of natural deposits.
*Nitrate. Infants below the age of six months who drink water
containing nitrate in excess of the MCL could become seriously
ill and, if untreated, may die. Symptoms include shortness of
breath and blue-baby syndrome.
Nitrates: As a precaution we always notify physicians and health
care providers in this area if there is ever a higher than normal
level of nitrates in the water supply.
LEAD AND
COPPER TESTING
Copper; AL, 1300; MCLG, 0; NWA Amount Detected, 2000; # of sites
found above the AL, 3 sites above the AL out of 60 sites sampled;
Sample Date, 1998; Typical Source of Contaminant, corrosion of
household plumbing systems.
*Copper. Copper is an essential nutrient, but some people who
drink water containing copper in excess of the action level over
a relatively short amount of time could experience gastrointestinal
distress. Some people who drink water containing copper in excess
of the action level over many years could suffer liver or kidney
damage. People with Wilson's Disease should consult the personal
doctor.
There Were No Lead
Sample Violations
MCL's are set at very stringent levels. To understand the possible
health effects described for many regulated constituents, a person
would have to drink 2 liters of water every day at the MCL level
for a lifetime to have a one-in-a-million chance of having the
described health effect.
As you can see by the table, our system had no violations, only
detects. We're proud that your drinking water meets or exceeds
all Federal and State Regulations. We have learned through our
monitoring and testing that some constituents have been detected.
The EPA has determined that your water IS SAFE at these levels.
A Memorandum signed May 4, l999 by Harold F. Reheis, Director
of the Georgia Environmental Protection Division, states that
Georgia Governor Roy Barnes has approved a special variance for
community water systems which served less than 10,000 consumers.
Since our system serves less than 10,000 consumers, the Nicholson
Water Authority chooses to exercise this option and not mail
the Water Quality Annual Report to each customer. The Water Department
will publish the report in the local newspaper. Also in the same
newspaper, the Nicholson Water Authority will provide Public
Notice that the report will not be mailed and that the reports
will be available upon request at the Nicholson Water Authority
Office, 588 Lakeview Drive.
Our Water Department is committed to providing our community
with sufficient quantity of clean, safe, and reliable drinking
water. If you have any questions concerning our drinking water
program or this water quality report call Ray L. Chester at (706)
757-2230. Board Meetings are scheduled monthly, as needed, at
the Nicholson Water Authority office at 7:00 p.m.
The Nicholson Water Authority is a vital part of our community
