Because of the default in the payment of a note executed by Ruth
D. House secured by a Deed to Secure Debt executed by Ruth D.
House to Regions Bank, dated September 25, 1996, and recorded
in the Clerk's Office of Banks County, Georgia, in Deed Book
110, Pages 531-532, subsequently modified by loan modification
agreement dated April 9, 1997, recorded in Deed Book 116, Pages
375-376, and by loan modification agreement dated March 3, 1998,
recorded in Deed Book 125, Page 571, Banks County Deed Records,
the undersigned has declared the full unpaid amount of the indebtedness
secured by said deed due and payable, and acting under the power
of sale contained in said deed, for the purpose of paying said
indebtedness, will on the first Tuesday in June, 2000, during
the legal hours of sale at the Courthouse in Banks County, Georgia,
sell at public outcry to the highest bidder for cash, the land
described in said deed to-wit:

Less and Except: All that tract or parcel of land containing
1.00 acre, more or less, in the 465th GMD of Banks County, Georgia,
and bounded now or formerly as follows: North by Tract 1, East
by Tract 1; South by lands of Doss; and West by land of Doss.
Said tract of land being more particularly described according
to a plat of survey prepared by Max Lewallen, Surveyor, on September
18, 1990, for Ruth D. House, and shown as Tract 2, which plat
is recorded in Plat Book 16, Page 12, of the Public Records of
Banks County and is by reference incorporated herein as part
of this description.
This property is subject to a prior deed to secure debt to Athens
Federal Savings Bank, n/k/a Synovas Financial, dated March 22,
1991, recorded in Deed Book 64, Page 185, Banks County Deed Records.
To the best knowledge and belief of the undersigned, the physical
address of the above described property is 350 Mitchell Road,
Maysville, Georgia.
Notice has been given of intention to collect attorney's fees
in accordance with the terms of the note secured by said Deed
to Secure Debt.
This sale will be held subject to any unpaid taxes or other assessments
which may be liens against said property.
Said property will be sold as the property of Ruth D. House and
the proceeds of said sale shall be applied first to the payment
in full of said indebtedness, next, to the payment of all expenses
connected with said sale, and the remainder, if any, shall be

Notice of Sale Under Power
By virtue of the power of sale contained in a Security Deed from
Kenneth W. Garland and Lorie Garland to Banc One Financial Services,
Inc., dated March 26, 1998, and recorded in Deed Book 126, Page
613, Banks County, Georgia Records; said Security Deed having
been given to secure a Note dated March 26, 1998, in the original
principal amount of Seventy Two Thousand Two Hundred Seventy
Six and 16/100 Dollars ($72,276.16), and by virtue of default
in payment of the indebtedness secured by said Security Deed,
the undersigned attorney-in-fact, who is the present holder of

The debt secured by said Security Deed and Note has been and
is hereby declared due because of non-payment thereof. Notice
has been given of intention to enforce provisions for collection
of attorney's fees and to foreclose in accordance with legal
requirements and the terms of the Security Deed and Note.
The debt remaining in default, the sale will be made for the
purpose of applying the proceeds thereof to the payment of the

Plans and specifications may be inspected at the general office
