Under and by virtue of the Power of Sale contained in a Deed to Secure Debt given by William Carter Gary to Jim Walter Homes, Inc., dated March 29, 1996, recorded in deed Book 15-P, Folio 209-211, Jackson County Records, conveying the after described property to secure a Note for the original indebtedness, with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Jackson County, Georgia, within the legal hours of sale on the first Tuesday in August, 2000, the following described property:
All that tract or parcel of land lying and being in the 455th District, G.M., Jackson County, Georgia, being Lot 2, consisting of 8.891 acres of Samples Estate, as shown upon that plat of survey prepared by In Transit Construction Surveying, dated January 20, 1989, revised 3-24-89, Daniel S. Mahan, Georgia Registered Surveyor No. 2275, recorded in Plat Book 29, Page 155, Jackson County, Georgia Courthouse Records, March 24, 1989.
Together with an easement for ingress and egress previously conveyed from Myrtle E. Samples to William Carter Gary, et. al., dated 8/23/89, filed 9/18/89 in Deed Book 10-X, Page 137, Jackson County, Georgia Records.
The debt secured by said Deed to Secure Debt has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Deed to Secure Debt. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Deed to Secure Debt and by law, including attorney's fees, notice of intent to collect attorney's fees having been given.
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Deed to Secure Debt first set out above, the same having been assigned to First Union National Bank of Florida and further assigned to William J. Wade, as Trustee of Mid-State Trust VI.
To the best knowledge and belief of the undersigned, the party in possession of the property is William Carter Gary and/or a tenant or tenants and said property is more commonly known as 204 Myrtle Drive, Maysville, Georgia 30558.

All that tract or parcel of land lying and being in the 455th District, G.M., Jackson County, Georgia, and being Lot 20 of Section I of Pleasant Acres Subdivision, as per Plat recorded in Plat Book 9, Page 200, in the Office of the Clerk of Superior Court of Jackson County, said Plat incorporated herein and made a part hereof by Reference.
Said property is commonly known as 655 Pinetree Circle, Maysville, GA 30558.
The indebtedness secured by said Security Deed has been and is hereby declared due because of default under the terms of said Security Deed and Note, including but not limited to the nonpayment of the indebtedness as and when due.
