Notice of Sale Under Power
Whereas, for value received, Charles L. Pitman, executed and
delivered to the First National Bank of Commerce ("First
Commerce"), a Deed to Secure Debt conveying certain real
estate located in Jackson County, Georgia, and said Deed to Secure
Debt was recorded in the Office of the Clerk of the Superior
Court of Jackson County, Georgia on January 25, 2000, in Deed
Book 20-U, Pages 764 through 766, securing that certain Promissory
Note in the original principal amount of Seventy-Five Thousand
Seven Hundred Eighty-One and 50/100 ($75,781.50) Dollars, said
Promissory Note being signed and executed by Charles L. Pitman;
and
Whereas, First Commerce is the holder of said Deed to Secure
Debt; and
Whereas, the Deed to Secure Debt held by First Commerce provides
that should default occur the holder may declare the entire indebtedness
secured by the Deed to Secure Debt due and payable and in compliance
with the Power of Sale, proceed to sell the property at public
outcry; and
Whereas, First Commerce has declared all of the indebtedness
secured by the Deed to Secure Debt due and payable; and
Whereas, First Commerce has forwarded the notice required by
O.C.G.A. Section 44-14-162.2;
Now, Therefore, First Commerce, acting as aforesaid, under and
in compliance with the Powers of Sale in the Deeds to Secure
Debt, will proceed to sell at public outcry, for cash or certified
funds to the highest bidder in front of the Courthouse in Jackson
County, Georgia during the legal hours of sale, on the first
Tuesday in October, 2000, the following described property contained
in said Deed to Secure Debt, to-wit:
All that tract or parcel of land lying and being in the 242nd
and 245th G.M.D., Jackson County, Georgia, designated as Lot
5, Dove Acres Subdivision, containing 1.633 acres, more or less,
and being particularly described according to a plat of survey
prepared for Dove Acres Subdivision, prepared by Venable &
Associates, Inc., registered surveyor, dated October 11, 1999,
recorded in Plat Book 54, Page 146, Jackson County records and
is incorporated herein by reference for a more complete description.
This conveyance is subject to all easements and rights of way
for roads and utilities now in use along with all easements and
restrictions of record. Together with a 1970 24x64 Fleetwood
mobile home, serial number S1682.
The proceeds of said sale will first be applied to the payment
of the indebtedness to First Commerce, other charges, and the
expenses of sale, as provided in the Deed to Secure Debt to First
Commerce, and the balance, if any, shall be applied or distributed
as required by law.

Pursuant to a Power of Sale contained in a certain Security Deed
executed by Gary Bryant, hereinafter referred to as Grantor,
with the singular including the plural, to Delta Funding Corporation
recorded in Deed Book 18-P, beginning at Page 178, of the deed
records of the Clerk of the Superior Court of the aforesaid state
and county, and by virtue of a default in the payment of the

concur on an administrative variance request, the request will

12.53 A decision on an administrative variance request shall
be made and issued in writing within 30 days from the date that
a complete application is sumitted to the County.
12.54 Any person or persons who may have substantial interest
