You are hereby notified that on the 6th day of November, 2000,
at 9:00 a.m., at the Jackson County Courthouse, the presiding
Judge of the Jackson County Superior Court will hear the case
of the State of Georgia vs. Jackson County Water and Sewerage
Authority and Jackson County, Civil Action File No. M001184 in
Jackson County Superior Court, the same being a proceeding to
confirm and validate Jackson County Water and Sewerage Authority
Water and Sewer Revenue Bonds, Series 2000A, in an aggregate
principal amount not to exceed $13,100,000, and Jackson County
Water and Sewerage Authority Water and Sewer Revenue Bonds, Series
2000B, in an aggregate principal amount not to exceed $3,100,000
to be issued by the Jackson County Water and Sewerage Authority
(the "Authority") and for the purpose of financing
the acquisition, construction, installation and equipping of
certain additions, extensions and improvements to the Authority's
water and sewerage system (the "System") and paying
costs in connection with issuance of the Bonds (the "Project")
and for other lawful uses. In said proceeding the Court will
also pass upon the validity of a Contract, as amended (the "2000A
Contract") to be entered into between the Jackson County
and the Authority, obligating the County to make payments to
the Authority, in consideration of the services and facilities
of the Authority, to the extent the net revenues of the System
are insufficient, in amounts sufficient to pay principal and
interest on said 2000A Bonds, and a 2000A Bond Resolution to
be adopted by the Authority (which, together with the 2000A Contract
between the County and the Authority, constitutes security for
the 2000A Bonds). The County will obligate itself under the 2000A
Contract, if necessary, to levy an annual tax on all taxable
property in the County at such rate or rates as may be necessary
to enable the County to pay the Authority the amounts required
pursuant to the terms of the 2000A Contract.
In said proceeding the Court will also pass upon the validity
of a Contract (the "2000B Contract") to be entered
into between the Jackson County and the Authority, obligating
the County to make payments to the Authority, in consideration
of the facilities and services of the Authority, in amounts sufficient
to pay principal and interest on said 2000B Bonds, and a 2000B
Bond Resolution to be adopted by the Authority (which, together
with the 2000B Contract between the County and the Authority,
constitutes security for the 2000B Bonds). The County will obligate
itself under the 2000B Contract to levy an annual tax on all
taxable property in the County at such rate or rates as may be
necessary to enable the County to pay the Authority the amounts
required pursuant to the terms of the 2000B Contract. The County
intends to make payments with respect to the 2000B Contract from
the revenues received pursuant to the County's special purpose
one percent sales and use tax.
Any citizen of the State of Georgia residing in Jackson County,
or any other person wherever residing who has a right to object,
may intervene and become a party to this proceeding.

Notice is hereby given that a special referendum election shall
be held on November 7, 2000, in conjunction with the 2000 General
Election, pursuant to Ga. Laws 2000, p. 950 (Act No. 735). The
special referendum election is for the purpose of presenting
to the voters the following question:
"Shall the Act be approved which exempts from ad valorem
taxes certain fixed and mobile farm equipment used by family
owned qualified farm products producers?"
All persons desiring to vote for approval of the Act shall vote
"Yes," and those persons desiring to vote for rejection
of the Act shall vote "No." If more than one-half of
the votes cast on such question are for approval of the Act,
then Section I of this Act shall become of full force and effect
on January 1, 2001, and shall apply to all tax years beginning
on or after that date. If the Act is not so approved or if the
election is not conducted as provided in this section, Section
I of this Act shall not become effective and this Act shall be
automatically repealed on the first day of January immediately
following that election date.

homestead exemption from all ad valorem taxation for state, county,
municipal, and school purposes in the same amount as that to
which a disabled veteran is entitled under other provisions of
law?"
All persons desiring to vote for approval of the Act shall vote
"Yes," and those persons desiring to vote for rejection
of the Act shall vote "No." If more than one-half of
the votes cast on such question are for approval of the Act,
then Section I of this Act shall become of full force and effect
on January 1, 2001, and shall apply to all tax years beginning
on or after that date. If the Act is not so approved or if the
election is not conducted as provided in this section, Section
I of this Act shall not become effective and this Act shall be

Petition for an Order Authorizing the Immediate Collection of
Motor Vehicle Ad Valorem Taxes That Will Come Due In January
and February 2001
Comes Now Jackson County, a political subdivision of the State
of Georgia, and petitions this court for an order authorizing
the immediate collection of motor vehicle ad valorem property
taxes that will come due in the months of January and February
2001 pursuant to O.C.G.A. §48-5-310, and shows the court
as follows:

Jerry Waddell, Chairman, and Pat Bell, Board member, are duly
elected members of the Board of Commissioners of Jackson County,
Georgia, a political subdivision of the State of Georgia. The
Board of Commissioners of Jackson County is the governing body
of said county.

Jackson County, Georgia is authorized under the laws of the State
of Georgia to levy and collect ad valorem taxes upon all motor
vehicles located within its jurisdiction.

The State Department of Revenue assesses the value of all motor
vehicles located in Jackson County and the State of Georgia for
ad valorem tax purposes for tax year 2000.

Pre-bill notices for motor vehicle ad valorem taxes that will
come due in January and February 2001 must be mailed to taxpayers
in Jackson County prior to the due date on the first day of each
month.

The county's 2000 tax digest has not been submitted for approval
by the Georgia Department of Revenue due to 2000 being a year
in which a total reevaluation is being performed of all property
located in Jackson County. As a result of the total reevaluation;
the county's 2000 tax digest is not ready for submission on the
Georgia Department of Revenue for approval.

On October 27, 2000, at an emergency called meeting, the Board
of Commissioners of Jackson County adopted a Resolution authorizing
the Jackson County attorney to file a petition seeking an order
authorizing the immediate collection of motor vehicle ad valorem
property taxes that will come due in January and February 2001.
A copy of the resolution is attached as "Exhibit A."

The collection of motor vehicle ad valorem taxes for the months
of January and February 2001 pending submission of a tax digest
for 2000 is available to Jackson County pursuant to O.C.G.A.
§48-5-310. Section 48-5-310(f)(3) allows taxes to be collected
using any reasonable method, which the court determines will
do substantial justice to the parties under the exigencies of
all the circumstances. Further, O.C.G.A. §48-5-311(g)(4)(B),
as amended, permits the court to order the collection of taxes.

Unless the court authorizes the immediate collection of motor
vehicle ad valorem taxes that will come due in January and February
2001, the citizens of Jackson County cannot avoid by practical
means the suffering of immediate and irreparably injury, loss,
damage, or any other significant matter in that drivers of motor
vehicles located in Jackson County will not be able to pay motor
vehicle ad valorem taxes and obtain the required sticker for
a motor vehicle tag and thus be in violation of the law requiring
a current sticker on a motor vehicle tag.

The governing body of Jackson County seeks an order which will
allow for immediate collection of motor vehicle ad valorem taxes
that will come due in January and February 2001 based upon the
millage rate for the various tax districts in Jackson County
according to the schedule attached as "Exhibit B."

The last year in which Jackson County had an approved tax digest
was 1999. Wherefore, petitioner prays to the court as follows:
(1) That the court enter an order authorizing the immediate collection
of motor vehicle ad valorem taxes that will come due in January
and February 2001 by the governing authority of Jackson County,
Georgia, based upon the millage rate for the various tax districts
in Jackson County according to the schedule attached as "Exhibit
B;" and (2) That the court grant such other and further
relief as may be deemed just and proper.

Whereas, Jackson County is authorized under the laws of the State
of Georgia to levy and collect motor vehicle ad valorem property

Whereas, as a result of 2000 being a year in which a total reevaluation
of all property located in Jackson County is being performed,

vehicle ad valorem taxes that will come due in January and February
2001, the citizens of Jackson County cannot avoid by practical
means the suffering of immediate and irreparably injury, loss,
damage, or any other significant matter in that drivers of motor
vehicles located in Jackson County will not be able to pay motor

Whereas, heretofore on December 13, 1995, Stephen L. Crawford
and Leann Crawford did execute a certain deed to secure debt
to Independence Mortgage Corporation of America, to the following
described property:
All that tract or parcel of land lying and being in the 1747
G.M.D., Jackson County, Georgia, designated as Lot 15, Block
A, Belle Spring Woods, containing 3.875 acres, more or less,
as shown on plat and survey of Venable & Associates, Inc.,
Surveyors, dated December 15, 1995, recorded in the Office of
the Clerk of Superior Court of Jackson County, Georgia, in Plat
Book 47, Page 212. For a more detailed description to said tract,
reference is hereby made to said plat as recorded. Subject to
existing easements and rights-of-way for public roads and utilities
now in use.
To secure an indebtedness evidenced by a promissory note of even
date therewith in the amount of $93,456.00 all as shown by a
deed to secure debt recorded in the Clerk's Office of the Superior
Court of Jackson County, Georgia, in Deed Book 15-E, Pages 145-149,
as modified by Modification Agreement recorded in the Clerk's
Office of Jackson County, Georgia, on October 31, 1996. Said
deed having been transferred and assigned to Lochaven Federal

Summary of Proposed Constitutional Amendments
Pursuant to requirements of the Georgia Constitution, Attorney
General Thurbert E. Baker, Secretary of State Cathy Cox, and
Legislative Counsel hereby provide the summaries of the proposed
constitutional amendments that will appear on the November 7,
2000, general election ballot for consideration by the people
of Georgia:

of a replacement for any member of the General Assembly who has

This proposal provides that upon the initial conviction of any
member of the General Assembly for any felony in a trial court
of this state or the United States, the member shall be immediately
suspended from office and a replacement member shall be elected
to serve for the duration of the suspension. The suspension lasts
until the end of the member's term or until the member's conviction
becomes final or the conviction is overturned, whichever is earlier.
The proposed amendment ensures legislative representation during
the suspension of a member of the state Senate or House of Representatives
upon initial conviction for a felony. The election of a replacement
member is the same as the procedure for filling a vacancy in
the General Assembly.

Shall the Constitution be amended so as to provide for a homeowner's
incentive adjustment for ad valorem property tax relief?"
This proposal provides for an adjustment on the ad valorem property
tax return of each taxpayer claiming the state-wide homestead
exemption. The amount of the adjustment may be equivalent to
a homestead exemption of up to $18,000.00 of the assessed value
of the homestead or the taxpayer's ad valorem tax liability on
the homestead, whichever is lower. Each year the General Assembly
may appropriate the amount of the tax credit as grants to local
governments and school districts for homeowner tax relief. The
procedures and conditions for the adjustments and grants shall
be subject to the provisions of general law. Enabling legislation
was enacted by Georgia Laws 1999, p. 273.

Shall the Constitution be amended so as to authorize the General
Assembly to provide a program of compensation for law enforcement
officers who become physically disabled, but not permanently
disabled, as a result of physical injury incurred in the line
of duty and caused by a willful act of violence and for firemen
who become physically disabled, but not permanently disabled,
as a result of physical injury incurred while fighting a fire,
which program shall entitle an injured law enforcement officer
or fireman to receive monthly compensation from the state in
an amount equal to such person's regular compensation for the
period of time that the law enforcement officer or fireman is
physically unable to perform the duties of his or her employment,
not exceeding 12 months and with certain exceptions?"
This proposal authorizes the General Assembly to provide for
a program of compensation for injuries incurred by law enforcement
officers and firemen who become physically disabled but not permanently
disabled in the line of duty. Monthly compensation from the state
in an amount equal to such person's regular compensation is authorized
for the period of time that the law enforcement officer or fireman
is physically unable to perform the duties of employment for
a period up to a total of 12 months. Satisfactory evidence of
disability shall be required and such benefits shall be subordinate
to workers' compensation benefits, disability, and other compensation
benefits awarded from an employer and shall be limited to the
difference between the benefits actually paid by the employer
and the amount of the person's regular compensation. Any law
enforcement officer or fireman who receives payments under the
state indemnification program for permanent disability is excluded
from this compensation program. Georgia Laws 2000, p. 283 enacts
certain exceptions and limitations and implements the program
effective upon the ratification of the amendment.

in the line of duty and to establish a nonlapsing fund for such
purposes with revenue from special and distinctive motor vehicle
license plates honoring state educators. Georgia Laws 2000, p.
768 creates the Georgia Public School Personnel Indemnification
Fund and provides for its administration effective upon the ratification
of the amendment.

of indemnification with respect to the death or permanent disability
of any state highway employee who is or at any time in the past
was killed or permanently disabled in the line of duty. Funds
shall be appropriated as necessary for payment of such indemnification
and for the purchase of insurance. Legislation is necessary to
implement the proposal.

ad valorem property tax purposes, and such class may be divided
into separate subclasses for ad valorem purposes and to authorize
the General Assembly to provide by general law for the ad valorem
taxation of marine vessels including, but not limited to, providing
for different rates, methods, assessment dates, and taxpayer
liability for such class and for each of its subclasses and need
not provide for uniformity of taxation with other classes of
property or between or within its subclasses?"
This proposal authorizes the creation of a separate class of
property for ad valorem property tax purposes to be known as
marine vessels and authorizes the creation of separate subclasses
of marine vessels for tax purposes. The General Assembly is authorized
to provide for different rates, methods, assessment dates, and
taxpayer liability for such class and need not provide for uniformity
with other classes of property or for uniformity among the subclasses
of marine vessels. The portion of any ad valorem tax on marine
vessels to be retained by the state shall be as provided by law.
Marine vessels are defined as all vessels used or capable of
being used as a means of transportation on water, except for
seaplanes. Legislation is necessary to implement the amendment.

This proposal increases the experience requirement for eligibility
for the office of state court judge by requiring that such persons
shall have been admitted to practice law for seven years. The
proposed amendment changes the requirement from five years to
seven years' experience and would not apply to state court judges
elected or appointed in the year 2000 or earlier. The proposal
is self-executing and requires no legislation for implementation.

homestead exemption from all ad valorem taxation for state, county,
municipal, and school purposes in the same amount as that to

This Act grants to the unremarried surviving spouse of a member
of the armed forces of the United Sates killed in service during
a war or armed conflict a homestead exemption from all ad valorem
taxation for state, county, municipal, and school purposes in
the same amount as that to which a disabled veteran is granted
by law. Current law only grants such an exemption to a disabled
veteran or the unremarried surviving spouse of a disabled veteran,
and the exemption amounts to $43,000.00.
If approved by a majority of the voters, the Act becomes effective
on January 1, 2001, and applies to all tax years beginning on
or after that date.
