Notice is hereby given that of a determination that there is no practical alternative to location in or impacting a floodplain by the following proposed project: Banks County Community Development Block Grant project - Water Line Construction. The County proposes to extend water lines to Alexander Road, Riverbend Road, Duncan Road, Borders Road, Hebron Road, Hebron Court and Sims Bridge Road. This project will be funded with Community Development Block Grant (CDBG) program funds and County funds.
1. The above described project must be located in the floodplain because: Two creek crossings are required. This will be the most direct, cost effective route to serve the target area. This includes a river crossing of Grove Creek and also small tributary creek to Hudson River. Pipe will be installed with minimum cover of 3' below creek bottom. The floodplain will be restored to its original condition.
2. Below is a description of all significant facts considered in making the determination including alternative sites and action.
Two solutions, in addition to the "no action" option, were examined in order to resolve the existing problems. If no action, Banks County citizens will still have no fire protection and an inferior and unreliable water supply system. The problems of inadequate wells and contamination from septic tank drain fields will continue.
Continued Expansion of system with SPLOST Funds is not acceptable. The County has aggressively installed water lines to expand the county wide water system. The SPLOST funds have been used to install lines predominantly on the main highways and connector streets; however, SPLOST funds are not used to make household connections. These are made by the homeowner. The low to moderate income citizens in the target area would not be able to hook on to the county system even if the waterlines were available. It could take 5 to 10 years before it would be feasible to make the recommended improvements with 100% SPLOST funds. In addition, the present SPLOST program expires in the year 2001 and may not be renewed.
Banks County proposes to construct improvements to the County's Water System. Banks County needs to install water lines and household connections in the proposed target area in order to provide adequate, safe and reliable water for the residents. This will allow the residents to disconnect from the individual wells and small private water systems. Fire hydrants will also be installed to provide fire protection.
3. The following statement indicates whether the actions conform to applicable state/local floodplain standards: The actions associated with the proposed project will conform with applicable state and local floodplain standards.
4. The following statement as to the applicability of the National Flood Insurance Program: Banks County participates in the FEMA National Flood Insurance Program.
5. The following statement describes how the activity will be designed or modified to minimize harm to the floodplain: The proposed project activities, construction of water improvements, will be designed so as to comply with state and local soil and erosion control standards to avoid disturbance of the floodplain.
6. The following statement indicates how the action affects or benefits natural floodplains values: The proposed water line extension will not negatively affect the floodplain's value.
7. The following statement lists other involved agencies and individuals: G. Ben Turnipseed Engineers and the Department of Natural Resources, Environmental Protection Division, (EPD).

Finding of No Significant Impact (FONSI)
It has been determined that such request for release of funds will not constitute an action significantly affecting the quality of human environment and accordingly the above named Banks County has decided not to prepare an Environmental Impact Statement under the National Environmental Policy Act of 1969 (P.L. 91-190).
The reasons for such determination not to prepare such statement are as follows:
The project will have no significant adverse impact on the environment.
An Environmental Review Record respecting the within project has been made by the Banks County which documents the environmental review of the project and more fully sets forth the reasons why such Statement is not required. This Environmental Review Record is on file at the above address and is available for public examination and copying upon request at the Banks County Courthouse, 144 Yonah Homer Road, Homer, Georgia 30547, Monday through Friday, between the hours of 8:00 a.m. and 5:00 p.m.
No further environmental review of such project is proposed to be conducted prior to the Request for Release of Funds.
Public Comments on FONSI
All interested agencies, groups and persons disagreeing with this decision are invited to submit written comments for consideration by the Banks County Board of Commissioners. Such written comments should be received at the Banks County Courthouse, 144 Yonah Homer Road, P.O. Box 130, Homer, Georgia 30547 on or before May 4, 2001. All such comments so received will be considered and Banks County will not request the release of CDBG funds or take administrative action on the within project prior to the date specified in the preceding sentence.
Notice of Intent to Request Release of Funds (NOI/RROF)
At least one day after the termination of the public comments period for the FONSI, but not before comments on the FONSI have been considered and resolved, Banks County will submit a Request for Release of Funds (RROF) and Certification to DCA. By so doing, Banks County will ask DCA to allow the County to commit funds to this project certifying that (1) it has performed the environmental review prescribed by HUD regulations ("Environmental Review Procedures for Title I Community Development Block Grant Program" - 24 CFR Part 58), and 2) the Certifying officer, Kenneth Brady, Chairman, consents to accept the jurisdiction of the federal courts if an action is brought to enforce responsibilities in relation to the environmental review or resulting decision making and action. The legal effect of the certification is by approving it, DCA will have satisfied its responsibilities under the National Environment Act thus allowing Banks County to commit Community Development Block Grant funds to this project.
Objection to
Release of Funds
DCA will accept objections to its approval only if it is on one of the following bases: (a) that the certification was not in fact executed by the certifying officer, or (b) that the applicant's environmental review record for the project indicates omission of a required decision, finding or step applicable to the project in the environmental review process.
Objection must be prepared and submitted in accordance with the required procedure (24 CFR Part 58) and may be addressed to: Georgia Department of Community Affairs, c/o CDBG Section, 60 Executive Park South, NE, Atlanta, Georgia 30329.
Objections to the release of funds on bases other than those cited above will not be considered by DCA. No objection received after May 21, 2001 will be considered by DCA.
