By virtue of the power contained in a Deed to Secure Debt executed
and delivered by Donna L. Simmons to Community Bank and Trust-Jackson,
dated April 13, 1999, and recorded in Deed Book 142, Page 467,
Banks County, Georgia Records, and recorded securing a note of
even date, and any other present or future indebtedness, in addition
to interest accruing, there will be sold at public outcry to
the highest bidder for cash, before the Courthouse door in Banks
County, Georgia, by the undersigned, acting as Attorney-in-Fact
for the said Donna L. Simmons, as provided in said Deed to Secure
Debt, between the hours of 10:00 a.m. and 4:00 p.m. Eastern Time,

All that tract or parcel of land lying and being in the 265th
District, G.M., Banks County, Georgia, and being that 0.246 acres,

prepared for Phi-Delta Masonic Lodge #148 by Eddie A. Borders,
Registered Surveyor, dated July 23, 1976, recorded in Plat Book
8, Page 150, in the Office of the Clerk of the Superior Court
of Banks County, Georgia, and incorporated herein and made a
part hereof by reference for a more detailed description. Said
property is bounded on the North and East by lands now or formerly
of Garrison Bros.; on the South by lands now or formerly of Chambers;
and on the West by U.S. Highway 441 (100 foot right of way).

The debt secured by said Deed to Secure Debt, being in default,
said powers contained therein will be exercised and the land
will be sold as property of Donna L. Simmons, by the undersigned,
as Attorney-in-Fact for the said Donna L. Simmons.
Said property shall be sold subject to any and all outstanding
easements and right-of-way, restrictions of record, if any, and
to all unpaid taxes and assessments.
The proceeds from said sale will be applied to the payment of
the above-styled indebtedness, the expenses of the procedure,
attorney's fees (notice as required in Sec. 13-1-11, O.C.G.A.,
1982, as amended, having been sent), and the balance, if any,
shall be applied as provided in said Deed to Secure Debt. Proper

Sealed proposals will be received by the Banks County Board of
Commissioners, Homer, Georgia, at the Banks County Courthouse
located at 144 Yonah-Homer Road, Homer, Georgia, until 12:00
noon, August 24, 2001. The work to be done consists of the furnishing
of all materials, labor and equipment for the construction of:
Banks Crossing Corridor TE Improvements. The project shall consist
of landscape, lighting and sidewalk installation at various locations
indicated in the plan set within the US 441 corridor, extending
approximately 0.75 mile north and 0.75 mile south of the I-85
interchange. There will be tree plantings, signage improvements,
and wheelchair ramp installation, etc. required at various locations
indicated by the landscape and sidewalk plan.
Plans and specifications will be available for pickup on Friday,
July 20, 2001, at the office of the project design firm, Hughes,
Good, O'Leary & Ryan, Inc. at 6 Executive Park Drive, Suite
300, Atlanta, Georgia, and will also be available at the mandatory
pre-bid conference. There will be a non-refundable charge of
$100.00 for the bid package. Make checks payable to Hughes, Good,

August 24, 2001, in the County Commission meeting room, Banks

Bank, FSB, dated 9/29/00, and recorded 10/12/00, in Deed Book
163, Page 286, Banks County, Georgia Records, securing subject
property with a note of that date in the original principal amount
of Sixty Three Thousand Three Hundred Thirty Seven Dollars ($63,337.00),
with interest on the unpaid balance until paid, having the address
of 207 Amber Lane, Commerce, Georgia. Having last been transferred
and assigned to La Salle Bank National Association, as Indenture
Trustee under the Indenture dated as of 10/1/00, series 2000-3,
