All that tract or parcel of land situate, lying and being in
the 207th District, G.M. Banks County, Georgia, encompassing
4.507 acres, more or less, as shown on a plat of survey entitled
"Survey for Johnny A. Garrett," prepared by Paul &
Evans Land Surveying, Inc., certified by Thomas R. Paul, Georgia
Registered Surveyor No. 2474, dated December 29, 1998, and being
of record in the Office of the Clerk of the Superior Court for
Banks County, Georgia, in Plat Book 23, Page 182, which said
plat and the recording thereof are by reference incorporated
herein for a more complete and detailed description.
Conveyed herewith is an easement for ingress and egress over
Barnes Road and Barnes Circle as the same are shown on plats
recorded in Plat Book 5, Page 289; Plat Book 8, Page 174; Plat
Book 9, Page 85; and Plat Book 9, Page 118, Banks County Public
Records. This conveyance is made subject to the rights of current
and subsequent owners of Lots 19-D, 19-E, and 19-F in the easement
referred to in the preceding sentence, this easement being shown
as Barnes Road Dirt as the same is shown in the northwest corner
of the subject property on the plat referenced in the preceding
paragraph.
The Grantor/Borrower represents, covenants and agrees that the

Page 445, Banks County Records, said Security Deed, having been
last sold, assigned, transferred and conveyed to Bank One, National
Association by Assignment, securing a Note in the original principal
amount of $60,000.00, the holder thereof pursuant to said Deed
and Note thereby secured has declared the entire amount of said

Notice of Election
TO THE QUALIFIED VOTERS OF BANKS COUNTY SCHOOL DISTRICT, GEORGIA:
NOTICE IS HEREBY GIVEN that on the 18th day of September, 2001,
an election will be held at the regular polling places in all
the election districts of the Banks County School District, Georgia
(which embraces all of Banks County), at which time there will
be submitted to the qualified voters of Banks County for their
determination the question of whether a sales and use tax of
one percent shall be continued on all sales and uses in Banks
County for a period of time not to exceed 20 calendar quarters,
commencing upon the expiration of the one percent sales and use
tax currently being levied in Banks County, to raise not more
than $16,000,000, the proceeds of such tax is to be used for
the purposes of providing funds to pay or to be applied toward
the cost of (i) the acquisition, construction, equipping and
furnishing of a new middle school and other school buildings
and facilities, (ii) the acquisition, construction, equipping
and furnishing of a high school athletic complex, (iii) adding
to, renovating, improving and equipping existing school buildings
and facilities, (iv) acquiring new school equipment, and (v)
acquiring any property necessary or desirable therefor, both
real and personal (the "Projects"), the maximum cost
of the Projects to be funded from the proceeds of such tax not
to exceed $16,000,000.
If the continuation of such tax is approved by the voters, such
vote shall also constitute approval of the issuance of general
obligation debt of the Banks County School District (which may
be in the form of notes, bonds or a loan) in an aggregate principal
amount of $12,050,000 (the "Debt"). The proceeds of
the Debt, if issued, shall be used to pay all or a portion of
the costs of the Projects, capitalized interest on the Debt through
October 1, 2002 and the costs of issuing the Debt.
The Debt, if so authorized, may be issued by Banks County School
District in whole or in part and in one or more series and shall
bear interest from the first day of the month during which the
Debt is to be issued or from such other date as may be designated
by the Banks County School District prior to the issuance of
the Debt, at a rate or rates not to exceed 6.0% per annum, payable
semiannually on the first days of April and October in each year,
commencing October 1, 2002, and the amount of principal to be
paid on October 1 in each year during the life of such debt shall
be as follows:

The principal and interest on the Debt is expected to be paid
from proceeds of the sales and use tax and shall be payable in
lawful money of the United States of America at a paying agent

County prior to the issuance of the Debt.
Any brochures, listings or other advertisements issued by the
Board of Education of Banks County or by any other person, firm,
corporation or association with the knowledge and consent of
the Board of Education of Banks County shall be deemed to be
a statement of intention of the Board of Education of Banks County
concerning the use of the proceeds of the Debt.
The ballots to be used at such election shall have written or
printed thereon substantially the following:

Banks County for a period of time not to exceed 20 calendar quarters,
