Notice of Sale Under Power
Whereas, for value received, John Michael McAvoy and Staci M.
McAvoy executed and delivered to the First National Bank of Commerce
("First Commerce") a Deed to Secure Debt, conveying
certain real estate located in Jackson County, Georgia, and said
Deed to Secure Debt, being dated August 10, 1999, was filed in
the Office of the Clerk of the Superior Court of Jackson County,
Georgia on August 11, 1999, and recorded on August 18, 1999,
in Deed Book 19-Z, Pages 710-713, Jackson County, Georgia Records,
securing that Promissory Note in the original principal amount
of thirty-three thousand seven hundred ten and 12/100 dollars
($33,710.12); and
Whereas, First Commerce is the holder of said Deed to Secure
Debt; and
Whereas, the Deed to Secure Debt held by First Commerce provides
that should default occur, the holder may declare the entire
indebtedness secured by the Deeds to Secure Debt due and payable
and in compliance with the Power of Sale therein, proceed to
sell the property at public outcry; and
Whereas, First Commerce has declared all indebtedness secured
by the Deed to Secure Debt due and payable; and
Whereas, First Commerce has forwarded the notice required by
O.C.G.A. §44-14-162.2;
Now, Therefore, First Commerce, acting as aforesaid under and
in compliance with the Power of Sale in the Deed to Secure Debt,
will proceed to sell at public outcry, for cash or certified
funds to the highest bidder in front of the Courthouse in Jackson
County, Georgia during the legal hours of sale, on the first
Tuesday in November, 2001 (being November 6, 2001), the following
described property conveyed in the said Deed to Secure Debt,
to-wit:
All that tract or parcel of land lying and being in the 465th
District, G.M., State of Georgia, County of Jackson, City of
Maysville, being Lot 2 of Tara Farms, encompassing 6.71 acres
and being more particularly described and delineated according
to a plat and survey prepared by W.T. Dunahoo and Associates,
Inc., certified by W.T. Dunahoo, Georgia Registered Surveyor
No. 1577, dated December 7, 1988, entitled "Survey for Tara
Farms," said plat being of record in the Office of the Clerk
of Superior Court of Jackson County, Georgia, in Plat Book 29,
Page 145; which said plat and the recording thereof are by reference
hereto incorporated herein for a more complete and detailed description.
Said property will be sold subject to any outstanding ad valorem
taxes (including taxes which are a lien, but not yet due and
payable), any matters which might be disclosed by an accurate
survey and inspection of the property, any assessments, liens,
encumbrances, zoning ordinances, restrictions, covenants, easements
and matters of record superior to the Deed to Secure Debt first
set out above.
To the best knowledge and belief of First Commerce the party
in possession of the property is John and Staci McAvoy.
The proceeds of said sale will first be applied to the payment
of the indebtedness to First Commerce, other charges, and the
expenses of sale, as provided in the Deed to Secure Debt to First
Commerce, and the balance, if any, shall be applied or distributed
as required by law.

Thursday, October 25, 2001, and closing after the first 42 applications

calls will be granted applications. DCA will give selection preference
to applicants who live or work in Jackson County.

The Town of Braselton's Planning Commission will hold a public
hearing on Thursday, November 1, 2001, at 6:00 p.m. at the Braselton
Community Center on the following requests:
Amended request for annexation and rezoning from Strickland River
Farms LLC of 214 acres located in unincorporated Barrow and Gwinnett
Counties on the Northside quadrant of the crossroads of Highway
211 and Liberty Church, a.k.a. Thompson Mill Road. Currently
zoned Agriculture. Requested zoning is PUD with a mixed-use residential
and commercial community planned.

Because of the default in payment of the indebtedness secured
by a Deed to Secure Debt executed by Ben D. Finch, Grantor ('s),
to Farm Equities, Inc., Grantee, dated March 12, 1996, recorded
in Deed Book 15-M, Page 688, in the office of the Clerk of Superior
Court of Jackson County, Georgia, the undersigned has declared
the entire amount of said indebtedness due and payable the first
Tuesday in November, 2001, during the legal hours of sale at
the Courthouse door in Jackson County, sell at public outcry
to the highest and best bidder for cash the following described
property:
All that tract or parcel of land and all improvements thereon,
lying and being in the City of Arcade, the County of Jackson,
the State of Georgia; Farm #14 in the Trotters Ridge Farms Subdivision
as shown on Plat Book 46, Page 114, Clerk's Office, Jackson County
Superior Court, to which reference is hereby made for a more
complete description and containing 2.33 acres. Address of said

The sale will be held subject to any other outstanding and unpaid

Notice has been given of intention to collect attorney's fees

Because of a default in the payment of a promissory note dated
July 31, 2000, and by virtue of the power of sale contained in
a Deed to Secure Debt dated July 31, 2000, executed by Raymond
C. Mills, recorded in Deed Book 21-S, Pages 517-520, Jackson
County, Georgia Records, Lindsay Diversified Interests, Inc.,
as current holder of said Note and Deed to Secure Debt, has declared
the indebtedness due in full under the above-described promissory
notes, and, pursuant to the power of sale contained in such Deed
to Secure Debt, will, on the first Tuesday in November, 2001,
during the legal hours of sale at the Courthouse door in Jackson
County, Georgia, sell at public outcry to the highest bidder
for cash the following property, to-wit:
All Those Tracts or Parcels of Land lying and being in the 255th
District, G.M., Jackson County, Georgia, and being that 1.41
acres, more or less, designated as Tract 2, as more particularly
shown on a plat of survey prepared for Perry Phillips by Allen
L. Venable, Jr., Registered Surveyor, dated May 3, 1990, revised

secured by said Deed to Secure Debt, the expenses and costs of
