by a Security Deed executed by Marlon Zaldivar to Union Planters

principal amount of $131,005.00, the holder thereof pursuant
to said Deed and Note thereby secured has declared the entire
amount of said indebtedness due and payable and, pursuant to

Whereas, for value received, John Michael McAvoy and Staci M.
McAvoy executed and delivered to the First National Bank of Commerce
("First Commerce") a Deed to Secure Debt, conveying
certain real estate located in Jackson County, Georgia, and said
Deed to Secure Debt, being dated August 10, 1999, was filed in
the Office of the Clerk of the Superior Court of Jackson County,
Georgia on August 11, 1999, and recorded on August 18, 1999,

securing that Promissory Note in the original principal amount

Whereas, First Commerce is the holder of said Deed to Secure

that should default occur, the holder may declare the entire

Because of a default in the payment of a promissory note dated
July 31, 2000, and by virtue of the power of sale contained in
a Deed to Secure Debt dated July 31, 2000, executed by Raymond
C. Mills, recorded in Deed Book 21-S, Pages 517-520, Jackson
