Under and by virtue of the Power of Sale contained in the Deed to Secure Debt from Tony Sparks to First Family Financial Services of Georgia, Inc., A Division of CitiFinancial Services, Inc., Its Successors and/or Assigns As Their Interest May Appear, dated September 27, 2000, and re-recorded December 20, 2000, in Deed Book 22-L, Page 630, Jackson County Records, said records given to secure an indebtedness in the original amount of $61,017.29, the undersigned will sell, at public outcry, to the highest bidder for cash, before the Courthouse door of Jackson County, Georgia, during the legal hours of sale, on the first Tuesday of March, 2002, the following described real property, to-wit:
All that tract or parcel of land lying and being in the 245th District, G.M., Jackson County, Georgia, containing 0.750 acres, more or less, and being designated as Tract 1, as shown on that plat of survey for Arcade Homes, Inc., prepared by W.T. Dunahoo and Associates, Surveyor, dated September 26, 1998, and recorded in the Office of the Clerk of the Superior Court of Jackson County, Georgia, in Plat Book 53, Page 94. Said plat, as recorded, is hereby incorporated by reference for a more detailed description of said property. Subject to existing easements for public roads and utilities now in use.
Together with 1992 Georgetown Double-Wide Mobile Home, Serial No. BHAL1091SN3460A and BHAL1091SN3460B.
The indebtedness secured by said Deed to Secure Debt has been, and is hereby declared to be due and payable in full by reason of default under the provisions of said Deed to Secure Debt and the terms of the Agreement secured thereby, and sale will be made for the purpose of applying the proceeds thereof to the payment of the indebtedness and interest thereon, attorney’s fees and expenses of sale, and balance remaining shall be applied as provided in said Deed to Secure Debt. Notice has been given of intention to collect attorney’s fees in accordance with the terms of the Note and Security Deed.
To the best of the knowledge and belief of the Lender, said property will be sold as the property of Tony Sparks and is subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above, including other Security Deeds. Tony Sparks was furnished with a copy of this Notice of Sale Under Power not less than fifteen (15) days prior to the sale.

Petition to Establish Title to Land
Comes Now, Petitioner and pursuant to O.G.C.A. Section 23-3-60, et.seq., files this Petition to establish title against all the world and shows this Honorable Court the following:
1. The land to which Petitioner seeks to establish title is all that tract or parcel of land lying and being in Land Lot, which is more particularly described in “Exhibit A,” attached hereto, and hereinafter referred to as “the Land.”
2. Petitioner is the sole owner of the Land.
3. The interest of the Petitioner is based upon (A) that certain warranty deed from Eddie Ruth Johnson and Robert Haywood Johnson to Coleman Classic Homes, Inc. dated December 13, 2001, and recorded December 18, 2001, in the office of the Clerk of Superior Court, Jackson County, Georgia, a copy of which is attached hereto as “Exhibit B” and (B) the open, peaceful, notorious, continuous and actual possession of the Property by Petitioner and Petitioner’s grantors for more than seven (7) years.
4. Petitioner is not aware of any adverse claims of record and is not aware of alleged adverse claims.
5. Petitioner is the owner of the lands adjoining the Land (the easterly line of the Land is Cabin Drive).
6. Counsel for Petitioner has prepared an abstract of title to the Land and said abstract and title notes will be made available to all interested parties, upon request.
7. Attached hereto as “Exhibit C” is a copy of the plat of survey of Land.
8. As required by O.G.C.A. Section 23-3-62, a notice of lis pendens is being field contemporaneously with this Petition.
9. Petitioner cannot immediately or effectually maintain or protect its rights by any other course other than the filing of this petition and is without adequate remedy at law, and unless a Court of Equity intervenes, Petitioner will suffer irreparable damage.
Wherefore, Petitioner prays for the following:
