Petition to Establish Title to Land
Comes Now, Petitioner and pursuant to O.G.C.A. Section 23-3-60, et.seq., files this Petition to establish title against all the world and shows this Honorable Court the following:
1. The land to which Petitioner seeks to establish title is all that tract or parcel of land lying and being in Land Lot, which is more particularly described in “Exhibit A,” attached hereto, and hereinafter referred to as “the Land.”
2. Petitioner is the sole owner of the Land.
3. The interest of the Petitioner is based upon (A) that certain warranty deed from Eddie Ruth Johnson and Robert Haywood Johnson to Coleman Classic Homes, Inc. dated December 13, 2001, and recorded December 18, 2001, in the office of the Clerk of Superior Court, Jackson County, Georgia, a copy of which is attached hereto as “Exhibit B” and (B) the open, peaceful, notorious, continuous and actual possession of the Property by Petitioner and Petitioner’s grantors for more than seven (7) years.
4. Petitioner is not aware of any adverse claims of record and is not aware of alleged adverse claims.
5. Petitioner is the owner of the lands adjoining the Land (the easterly line of the Land is Cabin Drive).
6. Counsel for Petitioner has prepared an abstract of title to the Land and said abstract and title notes will be made available to all interested parties, upon request.
7. Attached hereto as “Exhibit C” is a copy of the plat of survey of Land.
8. As required by O.G.C.A. Section 23-3-62, a notice of lis pendens is being field contemporaneously with this Petition.
9. Petitioner cannot immediately or effectually maintain or protect its rights by any other course other than the filing of this petition and is without adequate remedy at law, and unless a Court of Equity intervenes, Petitioner will suffer irreparable damage.
Wherefore, Petitioner prays for the following:
1. That the Court take jurisdiction of this matter as an action in rem requiring the appointment of a special master pursuant to Ga. Code Ann. Sections 23-3-63, et. seq.
2. That the Court appoint such special master and that this proceeding be referred to said special master by proper order pursuant to said code sections.
3. That Petitioner have a decree establishing its title in the Land against all the world and all clouds to Petitioner’s title to the Land be removed, and that said decree be recorded as provided by said code sections.
4. The Petitioner have such other and further relief as may be just and proper.
