Under and by virtue of the Power of Sale contained in a Security Deed given by Anthony Scott Lee and Rebecca Ann Lee to Chase Manhattan Mortgage Corporation, dated May 10, 2000, recorded in Deed Book 215, Page 168, Jackson County, Georgia Records, conveying the after-described property to secure a Note in the original principal amount of One Hundred Five Thousand One Hundred Thirty-Three and 0/100 Dollars ($105,133.00), with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Jackson County, Georgia, within the legal hours of sale on the first Tuesday in July, 2002, the following described property:

Under and by virtue of the power of sale contained in that certain Deed to Secure Debt and Security Agreement from Cypress Restaurants, Inc. (“Borrower”) to and in favor of Newcourt Commercial Finance Corporation, as predecessor in interest to CIT Lending Services Corporation (“Lender”) dated September 2, 1999, filed for record September 13, 1999, and recorded in Deed Book 20-E, Page 150, Jackson County, Georgia Records (the “Deed to Secure Debt”); the Deed to Secure Debt securing a note dated September 10, 1999, from Borrower to the order of Newcourt Commercial Finance Corporation, as predecessor in interest to CIT Lending Services Corporation (the “Note”), in the original principal sum of One Million Two Hundred Eighty-Two Thousand Eight Hundred Twenty-Four and No/100 Dollars ($1,282,824.00) with interest from the date thereof at the rate specified therein; there will be sold at public outcry by Lender as Attorney-in-Fact of Borrower to the highest bidder for cash between the legal hours for sale before the Courthouse door in Jackson County, Georgia, on the first Tuesday in July, 2002, the following described land, improvements and appurtenances (hereinafter collectively referred to as the “Premises”) to wit:

Together with all improvements, equipment and fixtures now owned or hereafter acquired by Borrower and located, affixed or attached or incorporated upon the Real Estate, including without limitation all furnaces, heating equipment, air conditioners, fans, water heaters, pipes, ducts, wiring and electrical fixtures, conduits, plumbing, sinks, partitions, restroom fixtures, light fixtures, windows and window coverings, and floor, ceiling and wall coverings, and all replacements thereof and substitutions therefore, (i) all rents, issues and profits, all insurance policies, and all insurance and condemnation awards and proceeds, arising from or related to the Real Estate and any business conducted on the Real Estate; and (ii) all proceeds, replacements and substitutions of or for any of the foregoing, and all books, records and files relating to any of the foregoing.
On account of default under the terms contained in the Note and the Deed to Secure Debt, the entire principal amount of the indebtedness evidenced by the Note, plus all accrued interest, late charges and other amounts which are or may be due under the Note and Deed to Secure Debt, have been accelerated and have been declared due and payable, and remain unpaid. The Deed to Secure Debt therefore has become and is now foreclosable according to its terms. Accordingly, the Premises will be sold at public outcry pursuant to the terms of the power of sale provided in the Deed to Secure Debt.
The Premises will be sold on an “as is, where is” basis without recourse against Lender and without representation or warranty of any kind or nature whatsoever by Lender with respect thereto.
The proceeds of the sale are to be applied first to the expenses of the sale and all proceedings in connection therewith, including attorney’s fees (notice of intention to collect attorney’s fees having been given), then to the payment of all sums secured by the Deed to Secure Debt, and the remainder, if any, will be paid to the person or persons legally entitled thereto, all as provided in the Note and Deed to Secure Debt. The Premises shall be sold as the property of Borrower, subject to all restrictions, easements and other matters of record that are prior to the Deed to Secure Debt and to which the Deed to Secure Debt is subject and to any unpaid city, county and state ad valorem taxes or assessments relating to the Premises.
To the best of the undersigned’s knowledge and belief, the owner of the Premises is the Borrower and the party or parties in possession of the Premises is the Borrower or tenants of the Borrower.

The Jackson County School System, Department of Special Education, announces its intention to destroy specific data. Records will be destroyed that were collected, maintained, or used in provision of a free appropriate public education for disabled students in Jackson County Schools. This notice is in compliance with the system’s comprehensive plan for special education required by P.L.94-142.
Records on students who enrolled in a special education program for the disabled and whose birthdays are between 06/02/74 and 06/01/75 are no longer needed for educational purposes. These records may be needed by the student or parents for Social Security or other reasons. The system plans to destroy these records on August 01, 2002, unless there has been a request for a due process hearing, under P.L.94-142 or a complaint filed with the Office of Civil Rights, under section 504 of the Rehabilitation Act of 1973.

The permanent easement in question extends ten feet (10’) on each side of the above-described line, thereby forming a twenty foot (20’) permanent easement.
