Under and by virtue of the power of sale contained in Deed to Secure Debt given by Andrew Britt Wilbanks to Regions Bank, dated December 3, 1997, recorded in Deed Book 17-I, at Pages 324-325, Jackson County, Georgia Records, there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door in Jackson County, Georgia, within the legal hours of sale on the first Tuesday in August, 2002, the following described property:
All that tract or parcel of land lying and being in the 245th (Jefferson) District, G.M., Jackson County, Georgia, containing three (3) acres, more or less, more particularly described according to plat prepared by Nat Hancock, Surveyor, in September, 1960, as follows: Beginning at a point on the north side of the Jefferson-Winder Highway on the right of way where said lot corners with lands of Berryman, said beginning point being north 60 degrees east 643.3 feet from the Finch line at meandering of branch and running along said highway right of way towards Jefferson, south 60 degrees 00 minutes west 643.3 feet to point in meandering of branch on Finch line, thence along meandering of branch, north 20 degrees 00 minutes west 209.0 feet to iron pin on branch, thence along Berryman line north 60 degrees 00 minutes east 609.0 feet to iron pin, thence south 30 degrees 00 minutes east 209.0 feet to the beginning corner. Bounded on the north and east by lands of Berryman, on the south by Georgia State Highway, being road leading from Jefferson to Winder and on the west by lands of Finch. Being the same property as described in warranty deed from Kenneth Wilbanks to John K. Wilbanks, Jr. and Andrew Britt Wilbanks, dated February 1, 1984, and recorded in the Office of the Clerk of Superior Court of Jackson County, Georgia. Less and Except Therefrom: All that tract or parcel of land lying and being in the 245th District, G.M., Jackson County, Georgia, consisting of 2.00 acres, more or less, and designated as Tract No. 1 in a plat of survey entitled “Survey for Kenneth Wilbanks,” dated January 20, 1982, by Allen L. Venable, Jr., Registered Surveyor, which is recorded in Plat Book 18, Page 230, in the Office of the Clerk of Superior Court of Jackson County, Georgia, and said plat of survey is hereby incorporated herein by reference.
Said Deed to Secure Debt having been given to secure a note of even date in the original principal amount of $40,000.00 with interest from date at the rate as specified therein.
The debt secured by said Deed to Secure Debt has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the note and Deed to Secure Debt. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Deed to Secure Debt and by law, including attorney’s fees (notice of intent to collect attorney’s fees having been given).

Vijai and Sohan L. The debt secured by said Deed to Secure Debt, being in default, said powers contained therein will be exercised and the land will be sold as property of Thomas Chacko and Gracey Chacko, by the undersigned, as Attorney-in-Fact for the said Thomas Chacko and Gracey Chacko.
Said property shall be sold subject to any and all outstanding easements and rights-of-ways, restrictions of record, if any, and to all unpaid taxes and assessments. Default has occurred and continues under the terms of the Note and Security Deed by reason of, among other possible events of default, the nonpayment when due of the indebtedness evidenced by the Note and secured by the Security Deed and the failure to comply with the terms and conditions of the Note and Security Deed. Jackson County is applying for funding assistance under Title 49 U.S.C. Section 5311 of the Federal Transit Act pertaining to rural and small urban areas.
The county will offer general public transportation to all citizens of Jackson County for any worthwhile purpose, including but not limited to shopping, medical treatment, social services and other purposes.
The county solicits private sector input and participation to assure that private for-profit transportation operators have a fair and timely opportunity to participate in the development of this program.
The county also solicits comments and concerns from the disabled population and their representatives to assure that issues relating to the disabled are addressed in the service design proposed during the planning process.
Interested persons are invited to request that a public hearing be held to discuss the services being offered or development of the application.
Written comments, requests for a public hearing and/or written notice of intent by private for-profit transportation operators to provide or participate in any or all of the above services should be submitted no later than fifteen (15) days from the date of this publication to:
