By virtue of the Power of Sale contained in a Deed to Secure Debt and its modifications from Tammy A. Bingham to Fidelity National Bank, as Custodian for Harold Fletcher Self Directed IRA, assigned to Habersham Bank, as Custodian for Harold Fletcher Self Directed IRA, dated May 15, 1999, and recorded at Deed Book 147, Pages 461-463, in the Office of the Clerk of Superior Court of Banks County, Georgia, there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door of Banks County, Georgia, during the legal hours of sale on the first Tuesday in January, 2003, the following described property, to-wit:
All that tract or parcel of land lying and being in the 207th GMD, Banks County, Georgia, being designated as Lot Number Seven (7), as more particularly shown and delineated on a plat of survey dated June 13, 1984, prepared by James M. Paul, Georgia Registered Land Surveyor, and recorded in Plat Book 10, Page 65, in the Office of the Clerk of Superior Court of Banks County, Georgia, which plat and the recordation thereof are by reference incorporated herein to aid in this description.
The above described property is conveyed subject to the following Restrictive Covenants:
(i) No building or structure shall be located nearer to a road line than 70 feet and nearer to any other property line than 12 feet.
(ii) No noxious or offensive trade or activity and no commercial hog raising or major commercial poultry raising or breeding shall be carried on upon the property nor shall anything be done thereon that may detract from the property or become an annoyance or nuisance to neighboring property.
(iii) No industrial or major commercial enterprise shall be carried on upon the property.
(iv) No junk and no inoperative or discarded motor vehicles shall be placed or allowed to remain on the property.
(v) All sanitary plumbing and water systems shall conform with the requirements of state and county health departments and similar agencies.
The debt secured by said instrument having been declared due because of default in payment, this sale will be made for the purpose of satisfying said indebtedness and any other indebtedness secured by said property and all expenses of this sale, including attorney’s fees. This property will be sold as the property of Tammy A. Bingham subject to any taxes, easements and assessments appearing of record.

Together with a non-exclusive perpetual easement for ingress and egress over, through and across a portion of Tract No. 1 and Tract No. 2 as shown on the above referenced plat, to-wit: twenty five (25) feet on each side of the centerline of existing County Dirt Road No. 100.

Coggins to Wells Fargo Home Mortgage, dated May 7, 2002, recorded in Deed Book 192, Page 291, Banks County, Georgia Records, conveying the after-described property to secure a Note in the original principal amount of ONE HUNDRED THOUSAND ONE HUNDRED EIGHTY AND 0/100 DOLLARS ($100,180.00), with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the Courthouse door of Banks County, Georgia, within the legal hours of sale on the first Tuesday in January, 2003, the following described property:

That tract or parcel of land lying and being in the 284th GMD of Banks County, Georgia, containing 2.0 acres, more or less, as shown on a plat of survey prepared for Howard Arroway and Tammie Fincannon dated January 28, 2001, recorded in Plat Book 25, Page 144, Banks County Records; said plat being incorporated herein by reference for a more complete description of the property.
Also conveyed herewith is a 2001 Fleetwood Anniversary, 26 x 50 manufactured home, Serial Number NCFL141AB53767-AV13 which is attached to and made a part of the real property.
The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Security Deed and by law, including attorney’s fees (notice of intent to collect attorney’s fees having been given).
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
To the best knowledge and belief of the undersigned, the party in possession of the property is Kathy J. Coggins or a tenant or tenants and said property is more commonly known as 788 Murray Road, Homer, GA 30547.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.
