Whereas, for value received, David Wilson, executed and delivered to nBank, N.A., that certain promissory note, dated March 28, 2002, in the original principal amount of Ninety Six Thousand One Hundred Seventy-Five and No/100 ($96,175.00) Dollars (the “Promissory Note”), with the Promissory Note being secured by a Deed to Secure Debt, conveying certain real estate located in Jackson County, Georgia, said Deed to Secure Debt being recorded in Deed Book 21-S, Pages 775-777 in the Office of the Clerk of the Superior Court of Jackson County, Georgia (the “Deed to Secure Debt”). Said Deed to Secure Debt was modified pursuant to Modification Agreements dated February 15, 2001, November 29, 2001, and March 28, 2002.
Whereas, nBank, N.A. is the holder of said Promissory Note and the Deed to Secure Debt secured thereby; and
Whereas, the Deed to Secure Debt held by nBank, N.A. provides that should default occur the holder may declare the entire indebtedness secured by the Deed to Secure Debt due and payable and in compliance with the power of sale, proceed to sell the property at public outcry; and

The Quad Cities Planning Commission will hold a public hearing on Tuesday, January 21, 2003, at 6 p.m. at the Jefferson Clubhouse, 302 Longview Drive, on the following matters:
Arcade
R-02-A13 Phil Davis to rezone property (5.8 acres) at 699 Ethridge Road from A-2 (county) to B-2 (city) for the purpose of commercial uses.
The City of Arcade is updating the Future Land Use text and map that will be incorporated into the Joint City/County Comprehensive Plan for Jackson County. Public review and comments will be considered.
Jefferson
The Jefferson City Council requests a review and recommendation of a proposed amendment to the Subdivision Regulations, Article XIV, Section 1402(E) to add streetlights as follows: “Streetlights must be installed in all subdivision developments within the City of Jefferson. Installation and maintenance of the streetlights is the responsibility of the developer until the release of the development maintenance bond.”

Under and by virtue of the Power of Sale contained in a certain Deed to Secure Debt from Noah John Stone III to Farm Equities, Inc., dated March 13, 1996, recorded at Deed Book 15-M, Page 698, Public Records of Jackson County, Georgia; there will be sold by Farm Equities, Inc., at public outcry before the Courthouse door in the said State and County, as Attorney-in-Fact for the maker of the said Deed to Secure Debt on the first Tuesday in January, being January 7, 2003, during the legal hours of sale to the highest bidder for cash, the following property, to-wit:
All that tract or parcel of land lying and being in the City of Arcade, the County of Jackson, the State of Georgia; Farm(s) #20 Trotters Ridge Farms Subdivision as shown on Plat Book 46, Page 114, Clerk’s Office, Jackson County Superior Court, to which reference is hereby made for a more complete description and containing 1.45 acres.
The above-described property shall include all easements and rights appurtenant thereto of the maker of the aforesaid Deed to Secure Debt; all of the rights, title or interest in and to all public and private ways adjoining the above-described property belonging to the maker of the aforesaid Deed to Secure Debt; and all other buildings, equipment, fixtures, and other improvements located on the above-described property and conveyed by the aforesaid Deed to Secure Debt.
The debt secured by the said Deed to Secure Debt being in default, and the holder having declared the balance of the indebtedness, this sale shall be for the purpose of paying the same, and the proceeds thereof will be applied to the payment of said indebtedness and all charges and expenses in connection with the foreclosure and the balance, if any, to be applied as provided by law.
Said property will be sold as the property of Noah John Stone III, which to the best of my knowledge and belief of the undersigned is in possession of the property, subject to any outstanding and unpaid taxes, street improvements, easements, restrictive covenants, and Deeds to Secure Debt appearing of record, if any.
A copy of this Notice of Sale is being mailed by certified mail to the Debtor pursuant to provisions of Official Code of Georgia Annotated Section 44-14-162.2.
