Whereas, heretofore on November 27, 1998, Vincent W. Eterno did execute and deliver to Community Bank & Trust a certain Deed to Secure Debt recorded in the Office of the Clerk of Superior Court of Banks County, Georgia, in Deed Book 138, Page 184, conveying the following described property, to-wit:
All that tract or parcel of land lying and being in the Berlin District of Banks County, Georgia, consisting of 5.01 acres and being known as Lot 4 of Webbs Creek Estate as shown on a plat of survey by Owen Patton and Chris M. Patton dated July 21, 1994. Said plat is attached hereto and herein incorporated by reference for a more complete description.
Subject to:
A twenty-foot easement for ingress and egress as shown on the above referenced plat.
All restrictions shown on the above referenced plat.
Easements of record for public roads and utilities.
The above described land will be sold subject to all unpaid taxes.
Whereas, the Note secured by said Deed to Secure Debt has become in default as to payment of the principal and interest, and Community Bank & Trust has given notice of its intention to foreclose said Deed to Secure Debt and claim attorney’s fees as provided in said Note and Deed to Secure Debt.
Now, Therefore, according to the terms of said Deed to Secure Debt and the laws in such cases made and provided, the undersigned will expose for sale to the highest and best bidder, for cash, the above-described land, after proper advertisement, on the first Tuesday in April, 2003, between the legal hours of sale before the Courthouse door in Homer, Banks County, Georgia. The proceeds from said sale will be used first to pay the costs and expenses of said sale, second to pay the indebtedness secured by said Deed to Secure Debt, and the balance, if any, delivered to the persons legally entitled thereto.

The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Security Deed and by law, including attorney’s fees (notice of intent to collect attorney’s fees having been given).

V-03-03 - Variance application for Sammy Reece for a property division that does not meet setback regulations. This property is located on Bennett Circle and is zoned ARR, Agricultural, Rural-Residential.
An ordinance to amend Section 74-205 entitled “Building Set Back Lines” of Article VII - Design standards for blocks and lots, Chapter 74 of the Code of Banks County, Georgia, by deleting Section 74-205 in its entirety and substituting in lieu thereof a new Section 74-205 with the same name for the purpose of setting forth the building set back requirements for lots in subdivisions located in Banks County; to provide for an effective date and to repeal conflicting ordinances and resolutions, and for other purposes.
An ordinance to amend Section 74-244 entitled “Minor Subdivisions” of Title VIII, Chapter 74 of the Code of Banks County by adding paragraph “F” to said section for the purpose of prohibiting the access to any additional property not located within the minor subdivision from the permitted easement; and providing for the upkeep and maintenance of any easement located within a minor subdivision; to provide for an effective date and to repeal conflicting ordinances and resolutions, and for other purposes.
An ordinance to amend paragraph A of Section 74-243 entitled “Minimum Access Standards and Prohibition of Chain Subdivisions In Class I and Class II Subdivisions” of Article VIII - Required improvements pertaining to subdivision, Chapter 74 of the Code of Banks County, Georgia, by deleting Paragraph A of Section 74-243 in its entirety and substituting in lieu thereof a new paragraph A to Section 74-243 for the purposes of providing for minimum access standards and to define immediate family; to provide for an effective date and to repeal conflicting ordinances and resolutions, and for other purposes.
An ordinance to amend Section 74-167 entitled “Street Right Of Way” of Article VI, Chapter 74 of the Code of Banks County by adding paragraph 4 to said section for the purpose of providing for the painting a solid white line on each side of the street in subdivisions in Banks County and painting a broken white line down the centerline of said street; to provide for an effective date and to repeal conflicting ordinances and resolutions, and for other purposes.
An ordinance to amend paragraph B of Section 411 entitled “Building Setbacks” of Article IV, Appendix A pertaining to zoning regulations of the Code of Banks County, Georgia, by deleting paragraph B of Section 411 in its entirety and substituting in lieu thereof a new paragraph B of Section 411 of Article IV, Appendix A of the Code of Banks County, Georgia, for the purpose of setting forth the building set back requirements in all zoning districts located in Banks County, except the general commercial district and the industrial district; to provide for an effective date and to repeal conflicting ordinances and resolutions, and for other purposes.
An ordinance to amend Article VIII “Required Improvements” of Chapter 74 of the Code of Banks County, Georgia, by deleting Section 74-238 entitled “Water Supply System” in its entirety and substituting in lieu thereof a new Section 74-238 with the same name for the purpose of requiring subdivisions to supply connections to water mains if a public water system is available; to provide for the physical requirements for water pipes and fire hydrants in subdivisions; to provide for an effective date and to repeal conflicting ordinances and resolutions, and for other purposes.
An ordinance to amend Section 74-122 entitled “Name of Subdivision” of Article V-General Design and other requirements pertaining to subdivisions, Chapter 74 of the Code of Banks County, Georgia, by deleting Section 74-122 in its entirety and substituting in lieu thereof a new Section 74-122 with the same name for the purpose of naming each subdivision and erecting a sign at the entrance of all Class III subdivisions designating the name of the subdivision; to provide for an effective date and to repeal conflicting ordinances and resolutions, and for other purposes.
An ordinance to delete Section 62-61 entitled “Street Names” of Article III, Chapter 62 of the Code of Banks County, Georgia, in its entirety and to substitute in lieu thereof a new Section 62-61 with the same name for the purpose of naming streets within the unincorporated boundaries of Banks County; to delete Section 62-62 entitled “Designation of Street Numbers” of Article III Chapter 62 of the Code of Banks County, Georgia, in its entirety and to substitute in lieu thereof a new Section 62-62 with the same name for the purpose of designating street numbers for dwelling units and places of business on all public and private streets and roads in Banks County; to delete Section 62-63 entitled “Posting of Designated Street Address” of Article III, Chapter 62 of the Code of Banks County, Georgia, in its entirety and to substitute in lieu thereof a new Section 62-63 with the same name for the purpose of setting forth the requirements for posting the assigned street number; to delete Section 62-64 entitled “Penalties” of Article III, Chapter 62 of the Code of Banks County, Georgia, in its entirety and to substitute in lieu thereof a new Section 62-64 with the same names for the purpose of providing for penalties and enforcement for violations of said article; to provide for an effective date and to repeal conflicting ordinances and resolutions, and for other purposes.
An ordinance to delete Section 74-162 entitled “Street Names” of Article VI of Chapter 74 of the Code of Banks County, Georgia, in its entirety and to substitute in lieu thereof a new Section 74-162 entitled “Street Names, Street Signs and Street Numbers” for the purpose of naming streets in each subdivision, indexing the same with the planning commission erecting street signs designating the name of the street in the subdivision, designating street numbers, and posting of designated street adresses; to provide for penalties, and enforcement of violations of said section; to provide for an effective date and to repeal conflicting ordinances and resolutions, and for other purposes.
The Banks County Planning Commission will hold a public hearing on the matters on Monday, April 7, 2003, at 7 p.m. in the courtroom located at the Banks County Courthouse in Homer, Georgia.
