All that tract or parcel of land containing 14.55 acres, more or less, in the 912th GMD of Banks County, Georgia, and bounded now or formerly as follows: north by Lot No. 26 and Moccasin Gap Road; East by Lot No. 24; South by Lot No. 21 and Lot No. 23; and West by Lot No. 17 and Lot No. 21.
Said tract of land being more particularly described according to a plat of survey prepared by Slate and Associates, surveyors, on February 16, 1998, for Sharon Satterfield, which plat is recorded in Plat Book 22, Page 160, of the Public Records of Banks County, and being shown as Lot No. 25, and is by reference incorporated herein as a part of this description.
Above tract shall not be used except for residential building lot. No trailer or mobile home shall be placed on said lot for a period of twenty years. No noxious or offensive activity shall be carried out upon said lot, nor shall anything be done thereon which may be or become an annoyance, nuisance, or disturbance to the neighborhood.
D. Aubrey Higgins has for himself, his heirs and assigns his unlimited right to use water from a certain deep well located on the above tract together with an easement for waterlines and access to said well from Moccasin Gap Road. D. Aubrey Higgins agrees to provide water to the owners of the above property at no cost to them as long as D. Aubrey Higgins uses said well.
Being the same property conveyed to Sharon Satterfield by deed from Eric G. Schackel and Linab O. Shackel recorded 02/26/1998 in Deed Book 125, Page 387, in the Office of the Clerk of Superior Court of Banks County, Georgia.

Williams executed a Promissory Note in the original principal amount of Forty-Three Thousand Five Hundred Thirty-Nine Dollars ($43,539.00) payable to The First National Bank of Habersham (n/k/a Regions Bank) which note was payable in monthly installments. Subsequently, John Douglas Williams and Dale M. Williams executed an additional Promissory Note in the original amount of Five Hundred Thirty-Four Thousand Six Hundred Nine Dollars and Ninety-Four Cents ($534,609.94) payable to Regions Bank which note was payable in monthly installments. This is the same property conveyed to John Douglas Williams and Dale M. Williams by virtue of a Warranty Deed from David A. Bray and Patricia F. Bray, dated February 28, 1996, recorded in Deed Book 104, Page 319.
Because John Douglas Williams and Dale M. Williams defaulted in fulfilling the terms of said Note and Deed to Secure Debt, Regions Bank pursuant to the terms of said Note and Deed to Secure Debt securing the same, has exercised its option and declared the entire balance due and collectible. Notice fixing the liability for attorney’s fees has been given as required by law.
