By virtue of the power contained in a Deed to Secure Debt executed and delivered by WILLIAM JOSEPH (CHIP) MCCLURE to COMMUNITY BANK AND TRUST, f/k/a COMMUNITY BANK AND TRUST-JACKSON, dated August 23, 2001, and recorded in Deed Book 188, Pages 851-852, Office of the Clerk of Superior Court of Banks County, Georgia, and recorded in Deed Book 521, Pages 148-149, Office of the Clerk of Superior Court of Franklin County, Georgia; securing sums in the original principal amount of $31,015.00; in addition to interest accruing, there will be sold at public outcry to the highest bidder for cash, before the Courthouse door in Banks County, Georgia, by the undersigned, acting as Attorney-in-Fact for the said WILLIAM JOSEPH (CHIP) MCCLURE, as provided in said Deed to Secure Debt, between the hours of 10:00 a.m. and 4:00 p.m. Eastern Time, on the first Tuesday in June 2003, to-wit: June 3, 2003:
All that tract or parcel of land lying and being in GMD, 1686, Franklin County, Georgia, and GMD, 208, Banks County, Georgia, containing 17.58 acres, as shown on a plat of survey identified as “Franklin Farms,” prepared by Hubert Lovell, Surveyor, dated October 11, 1988, and recorded at Plat Book 17, Page 323, Franklin County, Georgia Records and Plat Book 16, Page 26, Banks County, Georgia Records, which by reference is incorporated herein and made a part hereof.
The debt secured by said Deed to Secure Debt, being in default, said powers contained therein will be exercised and the land will be sold as property of WILLIAM JOSEPH (CHIP) MCCLURE, by the undersigned, as Attorney-in-Fact for the said WILLIAM JOSEPH (CHIP) MCCLURE.
Said property shall be sold subject to any and all outstanding easements and rights-of-ways, restrictions of record, if any, and to all unpaid taxes and assessments. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.
The proceeds from said sale will be applied to the payment of the above-styled indebtedness, the expenses of the procedure, attorney’s fees (notice as required in Sec. 13-1-11, O.C.G.A., 1982, as amended, having been sent as required), and the balance, if any, shall be applied as provided in said Deed to Secure Debt. Proper conveyance will be made to the purchaser at the said sale by the undersigned acting as Attorney-in-Fact for the said WILLIAM JOSEPH (CHIP) MCCLURE.
To the best knowledge, information, and belief of COMMUNITY BANK AND TRUST, f/k/a COMMUNITY BANK AND TRUST-JACKSON, the premises are currently occupied by debtor.

The Georgia Department of Community Affairs (DCA) which administers the Section 8 Rental Assistance Program will be accepting requests for applications for the Banks County waiting list from the first 10 eligible families to call our Athens office at (706) 369-5636 or toll free at (888) 318-0354 on Wednesday, June 4, 2003. Beginning at 8:00 a.m., we will accept telephone calls only from the first 10 eligible applicants, and will stop taking calls on Wednesday, June 4, 2003, at 4:00 p.m., whichever occurs first. No applications will be given at the door, and only one application will be sent per phone call. Of these 10 applications, 9 will be reserved for callers who live or work in Banks County. The remaining 1 application will be available for the first caller that does not live or work in Banks County. Callers must provide their name, mailing address and social security number at the time of the call in order to be eligible to receive an application.
Hearing impaired applicants may apply for assistance by telephoning TDD 1-800-736-1155 (Leave Message. You will be contacted the morning of the next business day). Visually impaired applicants needing assistance to complete the application form should make the DCA officer aware of this need at the time the application form is requested.
Current residents of public housing units and persons on the waiting list for public housing must make a separate application for Section 8 assistance to be considered for the Program. Completing the application will not affect your status on the waiting list for other programs.
DCA does not discriminate in admission or access to its Federally Assisted Housing Programs. Any individual eligible to be served who has visual or hearing impairment will be provided with the information necessary to understand and participate in DCA’s programs. Ms. Yvonne Hammonds has been designated as the responsible employee to coordinate DCA’s efforts to comply with the nondiscrimination based on handicap regulations.
