Contractors are invited to submit lump sum bids for Bid Packages One through Twenty 1-20 for the (Modifications & Additions) to Banks County Primary School; Homer, Georgia.
Sealed bids will be received by the Construction Manager until 4:00 p.m., Thursday, March 25, 2004, at the office of the Construction Manager, Charles Black Construction Co., P.O. Box 960, 1955 Highway 129 South, Cleveland, GA 30528. Bids must be submitted in duplicate on the Construction Manager’s proposal form. Some packages require a 5% Bid Bond as described in the bid package descriptions. A thorough review of the bid package descriptions and bid documents is required prior to submitting bids.
The form of agreement will be AGC Document 640, 1994 Edition, between the Construction Manager and the Successful Bidder.

YOU ARE HEREBY NOTIFIED that there will be heard before the Presiding Judge of the Superior Court of Cobb County, Georgia, on the 6th day of April, 2004, at 9:30 o’clock, A.M., at the Cobb County Courthouse in the City of Marietta, Georgia, the case of the State of Georgia vs. Development Authority of Cobb County and Waste Management of Georgia, Inc. and Georgia Waste Systems, Inc., Civil Action File Number 04-1-02071-99, in the Superior Court for that County, the same being a proceeding to confirm and validate an issue of not to exceed $20,000,000 in aggregate principal amount of Development Authority of Cobb County Solid Waste Disposal Revenue Bonds (Georgia Waste Management Project) Series 2004A (the “Bonds”) and the security therefor. Proceeds of the Bonds will be loaned to the Waste Management of Georgia, Inc. and Georgia Waste Systems, Inc. (collectively, the “Companies”) by the Development Authority of Cobb County under a Loan Agreement tentatively to be dated as of April 1, 2004 (the “Loan Agreement”), and will be used to finance or refinance a portion of the costs of (1) the acquisition of new collection vehicles, solid waste disposal containers, and related equipment, (2) the acquisition of certain solid waste disposal sorting and processing equipment to be located at various hauling and transfer stations, and (3) certain landfill development, including vertical and horizontal landfill cell development to create additional disposal area at currently permitted landfill sites and general improvements to the landfill sites, including various upgrades to the leachate collection systems and methane gas collection systems, other infrastructure improvements, and the acquisition of equipment located or to be located at certain of the Companies current facilities in Banks County, Charlton County, Cherokee County and Cobb County, Georgia, in accordance with existing permits (collectively, the “Project”), and paying costs of issuance related to the Bonds. The Court in such proceeding will also pass upon the validity and legality of such Loan Agreement, an Indenture under which the Bonds will be issued and a Guaranty which provide for payment of the Bonds, and an Underwriting Agreement under which the Bonds will be sold; all as defined in the Petition and Complaint.
Any citizen of the State of Georgia residing in Cobb County, or any other person wherever residing, who has a right to object, may intervene and become a party to these proceedings.

All that tract or parcel of land lying and being in the 912th G.M.D. of Banks County, Georgia, and being known and designated as Lot 11 of “Hudson Falls” Subdivision, consisting of 1.31 acres all as more fully shown by plat of survey by Russell N. Barlett, dated November 11, 1986, revised March 9, 1987, recorded in Plat Book 12, Folio 125, in the Office of the Clerk of Superior Court of Banks County, Georgia, said plat (hereinafter referred to as “Phase 2 Plat”) being referred to and incorporated herein for a more complete description.
Also Conveyed: A nonexclusive right of ingress and egress over and through the 60 foot wide strips for roadway purposes shown on the Hudson Falls Subdivision plat.
