Under and by virtue of the Power of Sale contained in a Security Deed given by Dale A. Rider and Tina D. Rider to Mortgage Electronic Registration Systems, Inc., dated February 13, 2001, recorded in Deed Book 22-T, Page 310, Jackson County, Georgia Records, conveying the after-described property to secure a Note in the original principal amount of FIFTY THOUSAND AND 0/100 DOLLARS ($50,000.00), with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the Courthouse door of Jackson County, Georgia, within the legal hours of sale on the first Tuesday in May, 2004, the following described property:

Pursuant to O.C.G.A. §9-11-4(f)(1)(C), this NOTICE of Service by Publication in the matter of Christine Huff, Petitioner vs. George W. Gann, and Parcel of Land being known as 2.54 acres, more or less, as recorded in Plat Book 63, Page 4, Public Records of Jackson County, Georgia, and All Other Parties or Entities, known or unknown, who have or claim any adverse Right, Title or Interest in the subject property (collectively, the “Respondents”), Civil Action Number A-04-CV-0352, in an Action to Quiet Title currently pending before the Honorable Robert W. Adamson in the Superior Court of Jackson County, Georgia. Said action was filed on April 1, 2003, and the Order granting Petitioner’s Motion for Service by Publication was granted on April 1, 2003.
Consequently, the Respondents are hereby given NOTICE that they are commanded to file with the Clerk of the Superior Court of Jackson County and serve upon Petitioner an answer to said petition within 60 days from the date of the Order for Service by Publication.

Also condemned in these proceedings is any title, estate, or any interest in the entire building, as well as the right to dismantle or remove the entire building labeled on the above referenced plat as “1-STORY WOOD”. Said building is located partially on the required right of way described above and partially on the remaining lands of the condemnee. Said building is situated approximately opposite station 0+566.17 on the construction centerline of Harris Lord Cemetery Road/County Road 57 on Georgia Highway Project EDS-441 (32).
The title, estate, or interest in the above described lands, required by condemnor and now taken by condemnor for public use is as follows: Fee simple title to the above described lands all as shown colored yellow on the plats dated the 28th day of June, 2000; Last Revised: Sheet No. 30 on August 18, 2003, and Sheet No. 33 on January 2, 2003, and attached to Appendix “A” to Exhibit “A” as Annex 1-A.
A temporary work easement is condemned for the right to enter upon the adjacent lands not condemned for the limited purpose of effectuating removal of a building acquired herein; and the work of removing this building shall be done in an expeditious manner with as little disruption to the remainder as is practicable under the circumstance. The easement will begin on the date possession is granted and continue until the building is removed or until December 31, 2006, whichever comes first, at which time said easement will expire. Said building being shown on the attached plat marked Annex 1-A and is labeled “1-STORY WOOD”.

Two temporary easements are condemned for the right to construct driveways to connect the newly constructed road and right of way to the condemnees remaining lands for driveway purposes. Said easements will expire on December 31, 2006, and are shown colored orange on the above mentioned plats. Upon completion of the project, the driveways will remain in place for use by the condemnee.
Two temporary easements are condemned for the right to construct fencing. Said easements will expire on December 31, 2006, and are shown colored pink on the above mentioned plats. Upon completion of the project, the condemnee shall have the right to use the easement areas in accordance with the applicable zoning restrictions, and the condemnor will cease maintenance of the easement areas.
Temporary work easements are condemned for the right to enter upon the adjacent lands not condemned for the limited purpose of effectuating removal of five buildings acquired herein; and the work of removing these buildings shall be done in an expeditious manner with as little disruption to the remainder as is practicable under the circumstance. The easements will begin on the date possession is granted and continue until the buildings are removed or until December 31, 2006, whichever comes first, at which time said easements will expire. The said named persons and any and all other persons known and unknown claiming any right, title, power, interest, ownership, equity, claim or demand in and to the lands hereinafter described, and all occupants, tenants, lessees, licensees and all holders, owners and users of ways and easements in, across, over and under said land are hereby notified, under the provisions of the Official Code of Georgia Annotated Sections 32-3-4 through 32-3-19, providing for the exercise of the power of eminent domain by the State of Georgia, or any of its subdivisions, or by any county of such State, as follows:
That the above stated case, being a condemnation in rem against the property hereinafter described, was filed in said Court on the 12th day of April, 2004; That, in accordance with provisions of the aforesaid Official Code, a Declaration of Taking, duly authorized and properly executed as provided by the Official Code, has been made and filed in said case, declaring the necessity for and exercising the power of taking the said described lands for State-aid public road purposes, thereby vesting the title to same in the Department of Transportation; and, in pursuance of such authority, the Department of Transportation has deposited with the Clerk of the Superior Court of said County $56,475.00 as the just compensation for the said lands described; and all persons claiming such fund or any interest therein, are hereby required to make known their claims to the Court;
In accordance with the provisions of the Official Code of Georgia Annotated, the Plaintiff-Condemnor has prayed the Court for Immediate possession of said property, and all persons having any interest in or claim against such property, as above set forth, are required by the Order of the Judge of said Court to surrender possession of the property to the Department of Transportation no later than 60 days from filing of the Declaration of Taking.

Upon completion of the project, the condemnee shall have the right to use the easement areas in accordance with the applicable zoning restrictions, and the condemnor will cease maintenance of the easement areas.
A temporary work easement is condemned for the right to enter upon the adjacent lands not condemned for the limited purpose of effectuating removal of a building acquired herein; and the work of removing this building shall be done in an expeditious manner with as little disruption to the remainder as is practicable under the circumstance. The easement will begin on the date possession is granted and continue until the building is removed or until December 31, 2006, whichever comes first, at which time said easement will expire. The Proposed Reconstruction of S.R. 15A/S.R. 82 and Kissam Street as a One-Way Pair
On Thursday, May 6, 2004, the Georgia Department of Transportation will hold a public hearing open house concerning Project BHF-052-2(20) Jackson County. The hearing will be held from 4:00 p.m. to 7:00 p.m. at the Jefferson High School, 575 Washington Street in Jefferson, Georgia.
The project would reconstruct the existing S.R. 15A/S.R. 335 intersection and existing roadways in the project area to create a one-way pair that would improve all intersections including both S.R. 335 and S.R. 15A and S.R. 82 split to acceptable design standards, improve visibility and improve the level of service without incurring any appreciable direct environmental impacts to the area. Further, the integrity of all National Register-eligible historic sites, including the bridge over Curry Creek, would be preserved and no adverse effects would result to any historic resources.
Representatives from the Department of Transportation will be available from 4:00 p.m. to 7:00 p.m. with plans and displays. The public is invited to attend this informal hearing anytime during these hours. There will be no formal presentation.
A court reporter will be available during this time to allow the public an opportunity to make comments about the project. These comments will be included in the transcript of the hearing.
The hearing displays will be available for review for ten days after the meeting at the Georgia Department of Transportation District One Office, located at 2505 Athens Highway, Gainesville, GA 30503. Also, as soon as the transcript is prepared it will be available at this location. Written statements will be accepted concerning this project until Monday, May 17, 2004. Written statements may be submitted to: Mr. Harvey D. The said named persons and any and all other persons known and unknown claiming any right, title, power, interest, ownership, equity, claim or demand in and to the lands hereinafter described, and all occupants, tenants, lessees, licensees and all holders, owners and users of ways and easements in, across, over and under said land are hereby notified, under the provisions of the Official Code of Georgia Annotated Sections 32-3-4 through 32-3-19, providing for the exercise of the power of eminent domain by the State of Georgia, or any of its subdivisions, or by any county of such State, as follows:
That the above stated case, being a condemnation in rem against the property hereinafter described, was filed in said Court on the 12th day of April, 2004; That, in accordance with provisions of the aforesaid Official Code, a Declaration of Taking, duly authorized and properly executed as provided by the Official Code, has been made and filed in said case, declaring the necessity for and exercising the power of taking the said described lands for State-aid public road purposes, thereby vesting the title to same in the Department of Transportation; and, in pursuance of such authority, the Department of Transportation has deposited with the Clerk of the Superior Court of said County $330,065.00 as the just compensation for the said lands described; and all persons claiming such fund or any interest therein, are hereby required to make known their claims to the Court;
In accordance with the provisions of the Official Code of Georgia Annotated, the Plaintiff-Condemnor has prayed the Court for Immediate possession of said property, and all persons having any interest in or claim against such property, as above set forth, are required by the Order of the Judge of said Court to surrender possession of the property to the Department of Transportation no later than 60 days from filing of the Declaration of Taking.

Also to be condemned in these proceedings is any title, estate, or any interest in the entire building, as well as the right to dismantle or remove the entire building labeled on the above reference plats as “BLDG. 69A”. Said building is located partially on the required right of way described above and partially on the remaining lands of the condemnee. Said building is situated approximately opposite station 19+535.00 on the construction centerline of U.S. 441 on Georgia Highway Project EDS-441(31).
The title, estate, or interest in the above described lands, required by condemnor and now taken by condemnor for public use is as follows: Fee simple title to the above described lands all as shown colored yellow on the plats dated the 30th of June, 2000; Last Revised: Sheet Nos. 44 and 45 on February 10, 2003, Sheet Nos. 46, 48 and 77 on October 14, 2003 and attached to Appendix “A” to Exhibit “A” as Annex 1-A.
A permanent easement is condemned for the right to construct and remove a sediment basin and is shown colored blue on the attached plats marked Annex 1-A. Said easement may also be used temporarily to construct fencing.
A temporary easement is condemned for the right to construct a driveway to connect the newly constructed road and right of way to the condemnees remaining lands for driveway purposes. Said easement will expire December 31, 2006, and is shown colored orange on the above mentioned plats. Upon completion of the project, the driveway will remain in place for use by the condemnees.
Three temporary easements are condemned for the right to construct fencing. Said easements will expire on December 31, 2006, and are shown colored pink on the above mentioned plats. Upon completion of the project, the condemnees shall have the right to use the easement areas in accordance with the applicable zoning restrictions, and the condemnor will cease maintenance of the easement areas.
A temporary work easement is condemned for the right to enter upon the adjacent lands not condemned for the limited purpose of effectuating removal of a building acquired herein; and the work of removing this building shall be done in an expeditious manner with as little disruption to the remainder as is practicable under the circumstance. The easement will begin on the date possession is granted and continue until the building is removed or until December 31, 2006, whichever comes first, at which time said easement will expire. Said building being shown on the attached plats marked Annex 1-A and is labeled “BLDG. 69A”. Said easement may also be used temporarily to remove any underground storage tanks as may be deemed necessary by the Department of Transportation.
