All that tract or parcel of land lying and being in the 207th District, G.M., Banks County, Georgia, and being that 10.92 acres, more or less, designated as Lot No. 21, on a final plat of survey of Grove River Estates prepared for Tommy Watkins Construction Co., Inc. by G. Brian Slate, Registered Surveyor, dated August 15, 2001, revised November 28, 2001, recorded in Plat Book D, Page 35 in the Office of the Clerk of the Superior Court of Banks County, Georgia, and incorporated herein and made a part hereof by reference for a more detailed description.
This conveyance is made subject to the following restrictions which shall run with the land;

The Town of Homer seeks to acquire the services of an engineering firm to provide engineering design services for a Transportation Enhancement (TE) project to enhance the area along U.S. Highway 441 located within the city limits of the Town of Homer, Georgia. The project is funded, in part, with Federal funds. Only pre-qualified engineering firms will be considered. Procedures for selection of a firm will be in accordance with the requirements of the Official Code of Georgia 50-22 and GDOT TOPPS Directive 4020, Consultants/Services Contracts. 2004 TE Grant Application

Description of the Proposed Project
Scope of this project is to enhance the area along U.S. Highway 441 located within the city limits of the Town of Homer, Georgia.
History: Homer is the county seat and has been the center of commerce within the county since being established. Homer is also located on U.S. Highway 441 which has been a major transportation artery for years. During the early 70’s the Banks Crossing area began to develop and people traveled from all over to visit the outlet malls and The Pottery. In addition, many people use the highway for their daily commute to Athens and the University of Georgia. The GDOT is ready to open the scenic Bypass around Homer. The opening of the new highway will at least cut the amount of traffic in half if not more. Most of the local businesses do not feel threatened by this since most of the traffic goes through Homer and does not stop because of the constant traffic on the road. Homer has not grown like other small towns but now has a great opportunity to create a downtown area around a very small but nationally recognized historic district. Several structures are on the national historic register. In addition, there is land available for development within the Homer city limits.
Master Plan Objective: To attract economic development that will add to the quality of life in the Town of Homer. There are many businesses that do well in a small town like a barbershop, a dry cleaners and a coffee shop which we have none. Our goal is to use the available resources to create an environment that will provide opportunities for local ownership of small, service oriented, people to people businesses. The first part of the plan is to clean and beautify the area while also providing safe walking passages to the area attractions and shops. Area attractions include the current historical sites like the old courthouse and the acquisition and possible renovation of other historical sites.
Project Phases: Phase one consists of acquiring right of way easements to extend and repair existing sidewalks to historical and designated development locations. The second phase is to add lighting around the square and along the sidewalks. The third phase is to create signage and landscaping to welcome visitors as they enter the city limits. The addition of plants, flowers and other foliage in key areas along the 441 corridor will complete the project.
In conjunction with the TE Grant project, an additional parallel project will be to raise funds from the private sector to repair and clean up our existing historical landmarks and other property where the current resident might be in need of assistance because of age or limited financial resources. This additional community effort, while mostly concerned with items outside of the scope of the TE Grant, will be used to help solicit additional funding. A portion of this funding may be used as part of the local matching funds for the TE Grant.
The scope will also include working with town officials in managing the requirements of the TE Grant from the beginning through project completion.
