Public Notice
The Braselton Planning Commission will hold a Public Hearing on Monday, October 25, 2004 at 7 p.m. on the following items:
I. 04-900-RZ
Request by Try-La, Inc. to annex and zone 5.79 acres into the Town of Braselton. The applicant has requested a G-C General Commercial zoning designation. The property is Barrow County Tax District 06 and Tax Parcels xx021-008, xx021-008c, xx021-008b, xx021-008a, currently zoned R-AG and R-2 and located at Highway 211. The applicant intends to develop the property for a hotel and restaurant.
II. 04-1000-RZ
Request by Chris Gray to annex and zone 26 acres into the Town of Braselton. The applicant has requested a G-C General Commercial zoning designation. The property is Barrow County Tax District 06 and Tax Parcels xx046A (043, 042, 041, 040, 011), currently zoned R-AG and R-2 and located at Highway 211 and Beaver Dam Road. The applicant intends to develop the property for Commercial and Office use.
III. Proposed amendments to the Braselton Development Code.
ARTICLE III - DEFINITIONS
Add the following definitions-
Clearing - The removal of trees or other vegetation, but not including
grubbing activities.
Grubbing - The removal of stumps or roots from a property.
Development Plans - The detailed and professional plans showing the layout and design, site work and construction activities proposed for a project (other than architectural building plans) and including the Preliminary Plat or Site Plan (as applicable), Grading Plan, Erosion and Sediment Control Plan, Stormwater Management Plan, Buffer and Landscape Plan, Street Lighting Plan, and construction drawings for streets, storm water drainage facilities, sanitary sewers, water supply facilities, and other site improvements.
Revise the following definitions-
Development Permit - An official authorization issued by the Planning and Development Department permitting clearing, grubbing, grading, or construction of storm drainage facilities, utilities, access drives, streets, parking or other improvements exclusive of buildings.
Buffer - Land area used to visibly separate one use from another through screening and distance, to shield or block noise, light, glare, or visual or other conditions, to block physical passage to non-similar areas, or to reduce air pollution, dust, dirt, and litter, or around a stream to slow and absorb runoff and reduce pollution to water. (see also stream buffer and undisturbed buffer)
SECTION 8.1 - USE BY DISTRICT TABLES
Permit Single Family Attached Dwellings in O-I (Office-Institutional) as a CONDITIONAL USE.
Permit Single Family Attached Dwellings in D-D (Downtown District) as a CONDITIONAL USE.
Change Two-Family Dwelling from being a permitted use in O-I (Office-Institutional) from being a permitted use to a CONDITIONAL USE.
SECTION 9.1.5 STANDARDS FOR CONSERVATION SUBDIVISIONS
Revise paragraph D. to add the following sentences -
Protected greenspace in individual private subdivision lots may count up to 10% of the required greenspace set aside. In such cases, the open space shall be protected from disturbance through a required conservation easement on the individual property.
Revise paragraph 3 -
Follow all other requirements contained in the Town of Braselton Subdivision and Development Regulations concerning the subdivision of land. No land disturbance or development permit shall be issued for a Conservation Subdivision until the Conservation Subdivision Concept Plan is approved by Mayor and Council. All future preliminary plats and development plans for the property must conform to the approved Concept Plan irregardless of transfer of ownership or phasing of the project. Amendments to an approved Conservation Subdivision Concept Plan must be approved by Mayor and Council.
SECTION 10.6 - LANDSCAPING REQUIREMENTS
Revise paragraph C -
Provide a minimum 15-foot wide landscaped strip between public arterial and collector road rights-of-way and off-street parking lots and a 10-foot wide landscaped strip between private streets or drives and off-street parking lots.
SECTION 10.7 - PARKING AND LOADING AREA REQUIREMENTS
Revise paragraph N. to read -
The following distances shall be provided between any parking lot and adjacent right-of-way of a public street or road:
Local Street - 15 feet
Collector Street - 20 feet
Arterial Street - 30 feet

14.9 - ISSUANCE OF DEVELOPMENT PERMIT
Revise paragraph A -
A. Upon approval of a Preliminary Plat, Site Plan and Development Plans, the Planning Director shall issue a Development Permit authorizing development activities to begin based on the approved documents. A Development Permit is an official authorization issued by the Department permitting clearing, grubbing, grading, or construction of storm drainage facilities, utilities, access drives, streets, parking or other improvements exclusive of buildings. A permit authorizing clearing, grubbing, and grading may be issued by the Planning Director prior to the issuance of a Development Permit based on approval of a grading plan, soil erosion and sedimentation control plan, and hydrology study by the applicable Soil and Water Conservation District.
The Braselton Planning Commission holds their meetings at the Braselton Community Center located at 126 Harrison Street. Copies of the applications and proposed amendments are available for Public Inspection at the Braselton Planning and Development Department located in the Braselton Town Hall at 4982 Highway 53.

Braselton Comprehensive Plan Update
The Town of Braselton will hold a Public Hearing on Thursday, October 7, 2004, at 4:00 p.m. at the Braselton Community Center, 126 Harrison Street. The purpose of this hearing is to inform the public about the content of the Braselton Comprehensive Plan Update as well as to receive public comment on the plan. A copy of the plan is available at City Hall between the hours of 8 a.m. and 5 p.m., Monday through Friday.
