Because of a default in the payment of the indebtedness secured by a Security Deed executed by GARY G. MASON and CAROLYN E. MASON to 1st Franklin Financial Corporation dated April 15, 1994, as shown of record in Deed Book 13-U at Page 704 with modification in Book 14-F at Page 221 and Book 19-U at Page 704 of the Jackson County Deed Records, securing a Note in the original principal amount of $6,125.49 the holder thereof pursuant to said Deed and Note thereby secured has declared the entire amount of said indebtedness due and payable pursuant to the power of sale contained in said Deed, will on the first Tuesday, December 7, 2004, during the legal hours of sale, before the Courthouse door in said County, sell at public outcry to the highest bidder for cash, the property described in said Deed, to wit:
All that tract or parcel of land, together with improvements thereon, lying and being in the 455th District, G.M., Jackson County, containing 1.50 acres, more or less, as shown on plat and survey of T.M. Patton & Associated, Surveyors, dated October 13, 1986, and recorded in the Office of the Clerk, Superior Court, Jackson County, in Plat Book 28, Page 113, reference being hereby made to said plat for a more complete description of the property herein conveyed.
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
This sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the older of the security deed.
Notice has been given of intention to collect attorney’s fees in accordance with the terms of the Note secured by this Deed.

The Power Sales Contracts further provide that if the revenues of any such Participant’s electric system or other funds are not sufficient for such purpose, such Participant shall assess and collect a continuing direct annual tax on all the taxable property within the boundaries of such Participant to the extent necessary to provide for any shortfall. The issuance of the Bonds shall not obligate the State of Georgia or any political subdivision thereof to levy or pledge any form of taxation whatever for the payment thereof. The Court will pass on the validity of the Bonds, the Power Sales Contract with the City of Acworth, certain Term Extension Amendments to said Power Sales Contracts with the Participants, among other things, extending the terms of said contracts, and the security for the Bonds.
