WHEREAS, in 1974 KATHRYN L. NEWMAN entered into a Co-Tenants’
Agreement with the undersigned, which Agreement is recorded in
the Clerk’s Office of the Superior Court of Banks County,
Georgia, in Deed Book 7, Pages 588-600, and
WHEREAS, said Co-Tenants’ Agreement was made in connection
with the purchase by KATHRYN L. NEWMAN of 5.555 acres undivided
interest in the property described by Exhibit “A”
attached hereto, and
WHEREAS, pursuant to the terms of said Co-Tenants’ Agreement,
the said KATHRYN L. NEWMAN agreed to pay the principal and interest
on the indebtedness of record related to her undivided interest,
together with a proportionate share of taxes and other expenses
attendant to the ownership of said property, and
WHEREAS, the undivided interest of KATHRYN L. NEWMAN was reduced
from 5.555 acres undivided interest to 4.54 acres undivided interest
by virtue of a Quit-Claim Deed executed by KATHRYN L. NEWMAN
in favor of Maingate Properties, Inc., dated April 20, 1976,
recorded in Deed Book 12, Page 296 of the Banks County, Georgia
Deed Records, and
WHEREAS, under the terms of said Co-Tenants’ Agreement
the said KATHRYN L. NEWMAN granted to the other co-tenants an
irrevocable power of attorney, the same being coupled with an
interest, to be exercised by at least sixty percent (60%) of
the remaining co-tenants for the purpose of selling all or a
part of the undivided interest of KATHRYN L. NEWMAN at auction
at the usual place for conducting sales at the Courthouse in
Banks County, Georgia to the highest bidder for cash after advertising
the time, terms and place of sale once a week for four (4) weeks
immediately preceding the sale, in a newspaper published in Banks
County or in the newspaper in which the Sheriff’s advertisements
for Banks County are published in the event that the said KATHRYN
L. NEWMAN failed, upon fifteen (15) days’ written notice,
to cure any default in the obligations contained in the Co-Tenants’
Agreement, and
WHEREAS, said KATHRYN L. NEWMAN has failed to pay any of the
obligations undertaken by her in the Co-Tenants’ Agreement
and is currently in default and in arrears in a sum in excess
of $38,282.02, and
WHEREAS, the undersigned have mailed to said KATHRYN L. NEWMAN
at her last known address notice of said default and a demand
that she pay all sums in arrears, and she has failed to do so,
and
WHEREAS, the undersigned constitute at least sixty percent (60%)
of the remaining co-tenants,
NOW, THEREFORE, the undersigned, acting under the power of sale
contained in said Agreement, for the purpose of paying the indebtedness
of KATHRYN L. NEWMAN will, on the first Tuesday in January, 2005,
during the legal hours of sale at the Courthouse in Banks County,
Georgia, sell at public outcry to the highest bidder for cash
the land and all improvements thereon Kathryn L. Newman’s
4.54 acre undivided interest in the property described by Exhibit
“A” attached hereto.
This sale will be held subject to any unpaid taxes or other assessments,
which may be liens against said property, and all easements and
covenants of record.
The indebtedness remaining in default, the sale will be made
for the purpose of applying proceeds thereof to the payment of
the indebtedness of KATHRYN L. NEWMAN secured by the Co-Tenants’
Agreement, accrued interest and expenses of the sale and other
sums secured by the Co-Tenants’ Agreement and the remainder
if any shall be applied as permitted by law.
To the best of the undersigned’s knowledge and belief the
undivided interest in the property is in the possession of the
undersigned Co-Tenants, James Arogeti as Executor of the Estate
of Marvin Nodvin, and Joe Nodvin, and said undivided interest
in the property will be sold as undivided 4.54 acre interest
in the property of KATHRYN L. NEWMAN.
The undersigned will execute a deed to the purchaser as authorized
in the aforementioned Co-Tenants’ Agreement.

Contractors are invited to submit lump sum bids for Bid Packages
One through Twenty-Six (1-26) for the Banks County Upper Elementary
School Addition & Renovation, Homer, Georgia.
Sealed bids will be received by the Construction Manager until
3:00 p.m., Thursday, December 16, 2004, at the office of the
Charles Black Construction Company, P.O. Box 960; 1955 Highway
129 South, Cleveland, GA 30528. Bids must be submitted in duplicate
on the Construction Manager’s proposal form. Some packages
require a 5% Bid Bond as described in the bid package descriptions.
