Notice of Sale Under Power
Georgia, Banks County
Under and by virtue of the Power of Sale contained in a Security
Deed given by Wanda Ayers to HomeBanc Mortgage Corporation, dated
March 13, 1995, recorded in Deed Book 95, Page 305, Banks County,
Georgia Records, as last transferred to Credit Based Asset Servicing
and Securitization, LLC by assignment to be recorded in the Office
of the Clerk of Superior Court of Banks County, Georgia, conveying
the after-described property to secure a Note in the original
principal amount of Fifty Four Thousand Seven Hundred & No/100
Dollars ($54,700.00), with interest thereon as set forth therein,
there will be sold at public outcry to the highest bidder for
cash before the Courthouse door of Banks County, Georgia, within
the legal hours of sale on the first Tuesday in July, 1999, the
following described property:

The debt secured by said Security Deed has been and is hereby
declared due because of, among other possible events of default,
failure to pay the indebtedness as and when due and in the manner
provided in the Note and Security Deed. The debt remaining in
default, this sale will be made for the purpose of paying the
same and all expenses of this sale, as provided in the Security
Deed and by law, including attorney's fees (notice of intent
to collect attorney's fees having been given.)
Said property will be sold subject to any outstanding ad valorem
taxes (including taxes which are a lien, but not yet due and
payable), any matters which might be disclosed by an accurate
survey and inspection of the property, any assessments, liens,
encumbrances, zoning ordinances, restrictions, covenants, and
matters of record superior to the Security Deed first set out
above.
To the best knowledge and belief of the undersigned, the party
in possession of the property is Wanda Ayers or a tenant or tenants
and said property is more commonly known as 340 Cedar Ridge Road,
Commerce, GA 30529.

Lot 19 of Cedar Ridge Properties, encompassing 2.10 acres, more
or less, as shown on a plat of survey entitled "Survey for
Wanda Ayers," prepared by Max Lewallen, certified by Max
Jackson Lewallen, Georgia Registered Surveyor No. 2067, dated
February 20, 1995 and being of record in the Office of the Clerk
of the Superior Court of Banks County, Georgia in Plat Book 18,
page 133, which said plat and the recording thereof are by reference
incorporated herein for a more complete and detailed description.

Notice of Sale Under Power
By virtue of the power contained in a Deed to Secure Debt executed
and delivered by David Reed to Community Bank and Trust-Jackson,
dated March 21, 1997, and recorded in Deed Book 115, Page 258,
Office of the Clerk of Superior Court of Banks County, Georgia;
which Deed to Secure Debt was supplemented by a Supplemental
Security Deed and Additional Loan Agreement dated June 9, 1997,
and recorded in Deed Book 117, Page 562, Office of the Clerk
of Superior Court of Banks County, Georgia; which Deed to Secure
Debt was further supplemented by a Supplemental Security Deed
and Additional Loan Agreement dated December 12, 1997, and recorded
in Deed Book 123, Page 384, Office of the Clerk of Superior Court
of Banks County, Georgia; which Deed to Secure Debt was further
supplemented by a Supplemental Security Deed and Additional Loan
Agreement dated August 4, 1998, and recorded in Deed Book 132,
page 736, Office of the Clerk of Superior Court of Banks County,
Georgia; securing sums now due, in addition to interest accruing,
there will be sold at public outcry to the highest bidder for
cash, before the Courthouse door in Banks County, Georgia, by
the undersigned, acting as Attorney-in-Fact for the said David
Reed, as provided in said Deed to Secure Debt, between the hours
of 10:00 a.m. and 4:00 p.m. Eastern Time, on the first Tuesday
in July 1999, to-wit: July 6, 1999:
All that tract or parcel of land, lying and being in the 265th
District, G.M., Banks County, Georgia, and containing 1.00 acre,
more or less, as shown on that Plat and Survey for the Charles
Company prepared by Venable & Associates, Surveyors, dated
October 5, 1988, and recorded in the Office of the Clerk of Superior
Court of Banks County, Georgia in Plat Book 14, Page 91. Said
plat, as recorded, is hereby referenced for a more detailed description
of said property. Subject to existing easements for public roads
and utilities now in use.
The debt secured by said Deed to Secure Debt, being in default,
said powers contained therein will be exercised and the land
will be sold as property of David Reed, by the undersigned, as
Attorney-in-Fact for the said David Reed.
Said property shall be sold subject to any and all outstanding
easements and rights-of way, restrictions of record, if any,
and to all unpaid taxes and assessments.
The proceeds from said sale will be applied to the payment of
the above-styled indebtedness, the expenses of the procedure,
attorney's fees (notice as required in Sec. 13-1-11, O.C.G.A.,
1982, as amended, having been sent as required), and the balance,
if any, shall be applied as provided in said Deed to Secure Debt.
Proper conveyance will be made to the purchaser at the said sale
by the undersigned acting as Attorney-in-Fact for the said David
Reed.
To the best knowledge, information, and belief of Community Bank
and Trust-Jackson, the premises is unoccupied.
Pursuant to the Fair Debt Collection Practices Act, it is required
that the following is stated: "This document is an attempt
to collect a debt and any information obtained will be used for
that purpose." [15 U.S.C. Section 1692e(11).]
