Whereas, heretofore on January 19, 1994, Larry Lee Reed did execute
and deliver to Habersham Bank a certain Deed to Secure Debt with
Power of Sale recorded in the office of the Clerk of Superior
Court of Banks County, Georgia, in Deed Book 85, Pages 787-788;
and modified by Additional/Renewal Loan Agreement and Affidavit
Regarding Intangible Tax, dated June 3, 1996, recorded in the
office of the Clerk of Superior Court of Banks County, Georgia,
in Deed Book 107, Page 68; and further modified by Additional/Renewal
Loan Agreement and Affidavit Regarding Intangible Tax, dated
March 17, 1995, recorded in the office of the office of the Clerk
of Superior Court of Banks County, Georgia, in Deed Book 95,
Page 314; and further modified by Additional/Renewal Loan Agreement
and Affidavit Regarding Intangible Tax, dated December 8, 1995,

in Deed Book 88, Page 485, conveying the following described
property, to-wit:
Tract One: All That Tract or parcel of land lying and being in
Homer, 265th District, G.M., and within the corporate limits
of Homer, Banks County, Georgia, and being a part of the J.B.G.
Logan Place, being shown and designated as all of Lot 23 and
all of Lot 24, on a plat of survey prepared for Helen D. Sikes
by J.G. King, G.R.S., dated May, 1967, a copy of said plat being
of record in the office of the Clerk of Superior Court of Banks
County, Georgia, in Plat Book 3, Page 60, to which said plat
and the record thereof reference is hereby made for a more complete
description.
Tract Two: All That Tract or parcel of land lying and being in
Homer, 265th District, G.M., and within the corporate limits
of Homer, Banks County, Georgia, and being a part of the J.B.G.
Logan Place, and being more particularly described as follows:
To find the true point of beginning, start at an iron pin located
on Woodland Drive, said iron pin being the southeast corner of
Lot #25, and proceed north along the boundary line of Lot #25
and right of way of Woodland Drive 50 feet to the true point
of beginning; from said true point of beginning, south 32 degrees
34 minutes East 50 feet to iron pin, said iron pin being the
southeast corner of Lot #25; thence north 54 degrees 13 minutes
East 121.5 feet to iron pin; thence North 29 degrees 25 minutes
West 50 feet to a point on right of way of road; thence across
Lot #25 to point of beginning. Said tract or land being a portion
of Lot #25 which is more particularly shown on a plat of survey
for Helen D. Sikes, prepared by J.G. King, Surveyor, dated May,
1967, which plat is recorded in Plat Book 3, Page 60, Banks County,
Georgia Records. Said plat and the recording thereof are incorporated
herein for a more detailed description of the portion of Lot
#25 conveyed herein.
Together with a 1972 Paragon Mobile Home, Manufacturer's ID No.
1381, Title No. 27010165, which is attached to and affixed to
the above-described real property.
The above described land will be sold subject to all unpaid taxes.
Whereas, the Note secured by said Deed to Secure Debt has become
in default as to payment of the principal and interest, and Habersham
Bank has given notice of its intention to foreclose said Deed
to Secure Debt and claim attorney's fees as provided in said
Note and Deed to Secure Debt.
Now, Therefore, according to the terms of said Deed to Secure
Debt and the laws in such cases made and provided, the undersigned
will expose for sale to the highest and best bidder, for cash,
the above-described land, after proper advertisement, on the
first Tuesday in August, 1999, between the legal hours of sale
before the Courthouse Door in Homer, Banks County, Georgia. The
proceeds from said sale will be used first to pay the costs and
expenses of said sale, second to pay the indebtedness secured
by said Deed to Secure Debt, and the balance, if any, delivered
to the persons legally entitled thereto.
Please be advised that Adams, Ellard & Frankum, P.C., is
retained counsel for Habersham Bank regarding the above-referenced
matter. All information obtained will be used for the purpose
of collecting the referenced debt.

By virtue of Power of Sale contained in Security Deed from Patsy
J. Coley to First Bank of Habersham, dated February 20, 1998,
which Deed is recorded among Banks County Records in Deed Book
125, page 271, said Security Deed being given to secure an indebtedness
of $60,000.00 plus interest. There will be sold by the undersigned
at public outcry to the highest bidder for cash before the Courthouse
Door at Banks County, Georgia, within the legal hours of sale
on the first Tuesday in August, 1999, the following described
property to-wit:
All that tract or parcel of land lying and being in the Poplar
Springs G.M.D. (912) of Banks County, Georgia, containing 9.7
acres, according to the Plat, dated November 5, 1971 of a survey
by Farley-Collins Associates, RLS, said Plat is incorporated
and made a part of this description and recorded in Plat Book
4 at Page 33 in the Office of the Clerk of Superior Court of
Banks County, Georgia.
This is the same property acquired by Rocky E. Brown and Linda
K. Brown from Stacia K. Smith, et al, by Deed, dated March 22,
1995, recorded in Deed Book 95 at Page 633 in said Clerk's Office.
The debt secured by said Security Deed has been and is hereby
declared due because of the non-payment of the current indebtedness
secured by said Deed to Secure Debt. Said property will be sold
as the property of Patsy J. Coley and subject to the outstanding
ad valorem taxes.
The proceeds of such sale should be applied first to the payment
in full of the aforementioned indebtedness, next to the payment
of all expenses connected with said sale, including attorney
fees, and the remainder if any, should be paid as provided in
said Deed to Secure Debt.
