Notice of Sale
Advertisement of Sale Under Power of Sale In Deed
to Secure Debt
Georgia, Jackson County
Under and by virtue of the powers contained in Deed to Secure Debt, executed by Huilett C. Medders to Tommy Watkins Construction Company, Inc., dated January 8, 1993, and recorded in Deed Book 12-V, Page 287, in the Office of the Clerk of Superior Court of Jackson County, Georgia, there will be sold at auction at public outcry to the highest bidder for cash at the Courthouse door in Jackson County, Georgia, by the undersigned acting as Attorney-in-Fact for the said Huilett C. Medders, between the hours of 10:00 o'clock a.m. and 4:00 o'clock p.m., Eastern Standard Time, on the first Tuesday in October, 1999, to-wit, October 5, 1999, the following described tract of land:
All that tract or parcel of land lying and being in the 465th District, G.M., Jackson County, Georgia, containing 33.40 acres, more or less, and having such areas, courses, directions, dimensions, distances, metes, shapes and bounds as shown by plat made by Clelland A. Tyson, Surveyor, dated August 31, 1992, recorded in Plat Book 40, at Page 46, Records of Jackson County, Georgia, to which reference is made and the description and record thereof incorporated herein as a part of this description by reference thereto.
This property conveyed subject to any and all easements and rights of ways of record.
Said above described tract of land being a portion of the property conveyed in a Warranty Deed from James Short to Tommy Watkins Construction Company, Inc. dated June 30, 1992, recorded in Deed Book 12-M, at Page 180, records of Jackson County, Georgia.
This deed is given subject and inferior to a certain Deed to Secure Debt dated January 8, 1993, from Huilett C. Medders to First Bank and Trust, recorded in Deed Book 12-V, at Pages 284-286, records of Jackson County, Georgia.
Said powers will be exercised and said land will be sold as the property of Huilett C. Medders by the undersigned as Attorney-in-Fact for the purpose of paying the indebtedness secured by said deed, attorney's fees, interest and costs of sale. The original indebtedness secured by said Deed to Secure Debt as evidenced by promissory note dated January 8, 1993 in the amount of Eight Thousand One Hundred Sixty and 00/100 Dollars ($8,160.00), bearing interest at the rate of eight percent (8.00%) per annum.
The Deed to Secure Debt securing said indebtedness above referred to, contained an open end clause declaring that said deed covered and secured not only the original amount stated therein, but also all extensions, renewals, additional loans and advances that might subsequently be made to borrowers to the Lender as well as all other indebtedness of borrowers to the Lender, then due or to become due or thereafter to be contracted.
Time was made the essence of the contract and the note contained provisions for payment of fifteen (15%) percent attorney's fees if collected by law or through an attorney at law.
Because the said Huilett C. Medders defaulted in making the payment of the installments as they matured, Tommy Watkins Construction Company, Inc., pursuant to the provisions of said note and the deed aforesaid securing same, has exercised its option and has declared the entire balance due and collectible, and has made demand on said note. Notice fixing the liability for attorney's fees has been given according to law. Said Deed to Secure Debt contained a power of sale authorizing the grantee as attorney-in-fact for the grantor therein to sell the property conveyed thereto in order to satisfy said note after advertising same once a week for four weeks in the official gazette in said county, and in accordance with said power of sale and by virtue thereof, Tommy Watkins Construction Company, Inc. will sell said land above described at the time and place hereinabove stated. Proper conveyances will be made to the purchaser by the undersigned as attorney-in-fact for Huilett C. Medders. Said property will be sold subject to all unpaid taxes that may be a lien on said property, subject to all easements of record.
This the 2nd day of September, 1999.
