Because of default in the payment of the indebtedness secured
by a Deed to Secure Debt executed by Jeff W. Banks and Michelle
D. Banks to FT Mortgage Companies, dba HomeBanc Mortgage Corporation,
dated April 12, 1996, and recorded in Deed Book 15-M, Page 623,
Jackson County, Georgia Records, in the original principal amount
of $72,900.00, the undersigned, Chase Manhattan Mortgage Corporation,
as Assignee of the aforementioned Deed to Secure Debt, pursuant
to said Deed and the Note thereby secured, has declared the entire
amount of said indebtedness due and payable, and pursuant to
said Power of Sale contained in said Deed, will on the first
Tuesday in October, 1999, during the legal hours of sale, at
the Courthouse door, Jackson County, sell at public outcry to
the highest bidder for cash, the property described in said Deed,
to-wit:
All that tract or parcel of land, together with improvements
thereon, situate, lying and being in Talmo District, GMD 1691,
Jackson County, Georgia, and being all of Lot 18 of Fountain

County Records, which Plat is incorporated herein by reference
for a more complete description of subject property.
Said property has the address of: 4494 Fountain Drive, Gillsville,
Georgia 30543.
Said property will be sold subject to any outstanding ad valorem
taxes (including taxes which are a lien, whether or not now due
and payable), any matters which might be disclosed by an accurate
survey and inspection of the property, any assessments, liens,
encumbrances, zoning ordinances, restrictions, covenants, and
matters of record superior to the Security Deed first set out
above.
Notice has been given of intention to collect attorney's fees
in accordance with the terms of the Note secured by said Deed.
Said property will be sold as the property of Jeff W. Banks and
Michelle D. Banks and the proceeds of said sale will be applied
to the payment of said indebtedness, accrued interest, expenses
of the sale and other sums secured by said Deed including attorney's

Whereas, on May 5, 1994, for value received, Bettie J. Gregory
executed and delivered to the United States of America, acting
through the United States Department of Agriculture, a Deed to
Secure Debt conveying certain real estate located in Jackson

The said named persons and any and all other persons known and
unknown claiming any right, title, power, interest, ownership,

Code of Georgia Annotated Sections 32-3-4 through 32-3-19, providing
for the exercise of the power of eminent domain by the State

That the above stated case, being a condemnation in rem against

Jefferson, Georgia, the presiding Judge of the Superior Court
of Jackson County will hear the case of the State of Georgia
vs. Jackson County Water and Sewerage Authority and Jackson County,
Georgia, Civil Action File No. X99CV0854 in the Superior Court
of Jackson County, the same being a proceeding to confirm and
validate an issue of (i) Jackson County Water and Sewerage Authority
(Georgia) Water Revenue Bonds, Series 1999A (the "Series
1999A Bonds"), in the aggregate principal amount of $3,525,000;
and (ii) Jackson County Water and Sewerage Authority (Georgia)
Water Revenue Bonds, Series 1999B (the "Series 1999B Bonds,"
and together with the Series 1999A Bonds, the "Bonds"),
in the aggregate principal amount of $4,055,000 to be issued
by the Jackson County Water and Sewerage Authority (the "Authority")
for the purpose of financing the cost of acquiring, constructing,
installing and equipping the expansion and improvement of the
water system and the cost of issuing the Bonds and the expenses
incident thereto. In said proceeding, the Court will also pass
upon the validity of a Contract, dated as of September 1, 1999,
between the Authority and the County, relating, among other things,
to the obligation thereunder by the County to make certain payments

Notice
The City of Gainesville will soon be constructing a new athletic
facility on Allen Creek Road east of town. The area includes
the former homeplace of William B. Owens. A small cemetery that
contains five graves is on the property. Only one grave has a
marker identifying the person as Riley Owens (1867-1870). The
cemetery will have to be relocated prior to construction. Georgia
law stipulates that descendants be notified of the intent to
move graves and allow input concerning the relocation and method
of re-entering the remains.
Various Owens family members lived in Hall and Jackson counties
in the early 1900's. If you are a descendant or know of any living
