The said named persons and any and all other persons known and unknown claiming any right, title, power, interest, ownership, equity, claim or demand in and to the lands hereinafter described, and all occupants, tenants, lessees, licensees and all holders, owners and users of ways and easements in, across, over and under said land are hereby notified, under the provisions of the Official Code of Georgia Annotated Sections 32-3-4 through 32-3-19, providing for the exercise of the power of eminent domain by the State of Georgia, or any of its subdivisions, or by any county of such State, as follows:

The said named persons and any and all other persons known and unknown claiming any right, title, power, interest, ownership, equity, claim or demand in and to the lands hereinafter described, and all occupants, tenants, lessees, licensees and all holders, owners and users of ways and easements in, across, over and under said land are hereby notified, under the provisions of the Official Code of Georgia Annotated Sections 32-3-4 through 32-3-19, providing for the exercise of the power of eminent domain by the State of Georgia, or any of its subdivisions, or by any county of such State, as follows:
That the above stated case, being a condemnation in rem against the property hereinafter described, was filed in said Court on the 1st day of October, 1999; That, in accordance with provisions of the aforesaid Official Code, a Declaration of Taking, duly authorized and properly executed as provided by the Official Code, has been made and filed in said case, declaring the necessity for and exercising the power of taking the said described lands for State-aid public road purposes, thereby vesting the title to same in the Department of Transportation; and, in pursuance of such authority, the Department of Transportation has deposited with the Clerk of the Superior Court of said County $10,135.00 as the just compensation for the said lands described; and all persons claiming such fund or any interest therein, are hereby required to make known their claims to the Court;
In accordance with the provisions of the Official Code of Georgia Annotated, the Plaintiff-Condemnor has prayed the Court for Immediate possession of said property, and all persons having any interest in or claim against such property, as above set forth, are required by the Order of the Judge of said Court to surrender possession of the property to the Department of Transportation no later than 60 days from filing of the Declaration of Taking.
That in accordance with the Official Code of Georgia Annotated Section 32-3-13 through 32-3-19, if the owner, or any of the owners, or any person having a claim against or interest in said property, shall be dissatisfied with the compensation, as estimated in the Declaration of Taking and deposited in Court, such person or persons, or any of them, shall have the right, at any time subsequent to the filing of the Declaration and the deposit of the fund into Court but not later than 30 days following the date of service as provided for in the official Code of Georgia Annotated Sections 32-3-8 through 32-3-10 to file with the Court a notice of appeal, the same to be in writing and made a part of the record in the proceedings.

Rakestraw with the existing southwestern right-of-way line of U.S. 129/State Route 15, said point being 0.77 feet left of and opposite station 15+661.6517 on the survey centerline of Georgia Highway Project STP-2434(2); running thence southwesterly along said property line a distance of 126.37 feet to a point 124.67 feet left of and opposite station 15+653.8373 on said centerline; thence northwesterly 277.76 feet along the arc of a curve to the left (said curve having a radius of 1,925.85 feet and a chord distance of 277.52 feet on a bearing of N 56° 12' 07" W) to a point 124.67 feet left of and opposite station 15+743.9792 on said centerline, said point also being a point on the northwestern property line of the condemnees; thence northeasterly along said later property line a distance of 126.01 feet to a point 1.31 feet right of and opposite station 15+744.8015 on said centerline, said point also being a point on said existing southwestern right-of-way line of U.S. 129/State Route 15; thence southeasterly along said existing right-of-way line a distance of 272.85 feet back to the point of Beginning. Said described land being the required right-of-way and is shown colored yellow on the attached plats marked Annex 1-A.
Also to be acquired is 277.76 linear feet of access rights along the southwestern required right-of-way line, beginning at the property line between the lands of the condemnees and the lands now or formerly owned by Charlie C. Rakestraw at station 15+653.8373 on the survey centerline of Georgia Highway Project STP-2434(2) and ending at the northwestern property line of the condemnees at station 15+743.9792 on said centerline.
The title, estate or interest in the above described lands, required by condemnor and now taken by condemnor for public use as rights-of-way for a Limited Access Highway as defined under the Official Code of Georgia Annotated sections 32-6-110 through 32-6-119 is as follows: Fee simple title to all the above described lands as shown colored yellow on the attached plats marked Annex 1-A and such access rights as may be required between the condemnees remaining real property and existing roads, streets or highways, intersecting or adjacent to the Limited Access Highway, such access rights and lands being specifically delineated on Department of Transportation plats dated the 30th day of July, 1996; Last Revised: Sheet Nos. 6 and 8 on July 26, 1999 and Sheet No. 7 on February 3, 1999 and attached to Appendix "A" to Exhibit "A" as Annex 1-A.

Public Hearing for
Project STP-002-6(52)(53)
Clarke and Jackson Counties

On November 15, 1999, the Georgia Department of Transportation will hold a public hearing concerning the proposed Location and Design of Project STP-002-6(52)(53), Clarke and Jackson Counties. The hearing will be held from 4:00 p.m. to 7:00 p.m. in the gymnasium of South Jackson Elementary School located at 8144 Jefferson Hwy., Athens, Georgia 30607.
Project STP-002-6(52)(53), Clarke and Jackson Counties, consists of the widening and reconstruction of US 129/SR 15 from SR 330/Lavender Road in Clarke County to the proposed Jefferson Bypass near CR 104 in Jackson County. The proposed project would widen the existing roadway from two lanes to four lanes separated by a 44-foot median.
The proposed widening would begin on the west side of US 129/SR 15 at the end of the existing four lane section of SR 330/Lavender Road and proceed to a point just north of CR 116/Fuller Road. From this point, the widening would cross over to the east side for approximately 0.68 mile to a point just north of CR 119. From there, the widening would shift to the west side and continue to the northern terminus of the project near CR 104.
The typical section for the project would be a rural section (open ditch) consisting of four 12-foot lanes separated by a 44-foot grass median with 10-foot shoulders and a 200 foot right-of-way. The existing roadway is two lanes with a right-of-way which varies from 80 feet to 100 feet. From Brock Road to Crooked Creek Road, the grassed median has been reduced to 32 feet on 150 foot of right-of-way to avoid a historic resource, the Segars-Smith House, and to avoid an elementary school. The total project length is 10.4 miles.
Representatives from the Department of Transportation will be available from 4:00 to 7:00 p.m. with plans and displays. The public will have an opportunity to attend the hearing at its convenience to ask questions and discuss the project with a Department representative. Relocation assistance will be discussed at the hearing. There will be no formal presentation.
A court reporter will be available during this time to allow the public an opportunity to make comments about the project. These comments will be included in the transcript of the hearing.
