in Deed to Secure Debt

Under and by virtue of the Power of Sale contained in that certain
Deed to Secure Debt from Guy L. Johnson to Approved Residential
Mortgage, Inc. dated May 15, 1998, and recorded in Deed Book
17-Y, Page 205, Jackson County Records, which deed was subsequently
transferred to Associates Home Equity Services, Inc. f/k/a Ford
Consumer Finance Company, Inc. by instrument recorded in aforesaid
records, the undersigned will sell at public outcry to the highest
bidder for cash before the Courthouse door in said County, during
the legal hours of sale, on the first Tuesday in December 1999,
by Associates Home Equity Services, Inc. f/k/a Ford Consumer
Finance Company, Inc., as Attorney-in-Fact for Guy L. Johnson
the following described property:
All that tract or parcel of land, situate, lying and being in
the 255th District, G.M. Jackson County, Georgia, containing
2.594 acres, more or less, and designated as Tract No. 1, as
shown by that certain plat of survey entitled "Final Plat
of Harden Orchard Estates" prepared by Hambrick Surveying,
Inc., certified by Wallace Long Hambrick, Georgia Registered
Surveyor, dated January 22, 1990, and being of record in the
Office of the Clerk of the Superior Court for Jackson County,
Georgia, in Plat Book 29, Page 249, which plat and its recording
are by reference incorporated herein for further identification
and description.
Said property is known as 256 Old Harden Orchard Road, Commerce,
Georgia.
The indebtedness secured by said Deed to Secure Debt having been
declared due and payable because of default in the payment of
the indebtedness secured thereby, this sale will be made for
the purposes of paying the same and all expenses of sale, including
attorney's fees, (notice having been given as provided by law).
The property will be sold as the property of The Aforesaid Grantors
subject to the following:
(1) all prior restrictive covenants, easements, rights-of-way
or encumbrances; (2) all valid zoning ordinances; (3) matters
which would be disclosed by an accurate survey of the property;
and the outstanding ad valorem taxes and assessments, if any,
and unpaid water and sewage bills, that constitute liens against
the property, whether due and payable or not yet due and payable;
and (4) matters of record superior to the security deed first
set out above.
To the best of the undersigned's knowledge and belief, the party

By virtue of the power contained in a Deed to Secure Debt executed
and delivered by Jeffery W. Roberts to Community Bank and Trust-Jackson,
dated May 2, 1997, and recorded in Deed Book 16-O, Pages 513-516,
Office of the Clerk of Superior Court of Jackson County, Georgia;
securing sums in the original principal amount of $145,000.00,
in addition to interest accruing, there will be sold at public
outcry to the highest bidder for cash, before the Courthouse
door in Jackson County, Georgia, by the undersigned, acting as
Attorney-in-Fact for the said Jeffrey W. Roberts, as provided
in said Deed to Secure Debt, between the hours of 10:00 a.m.
and 4:00 p.m. Eastern Time, on the first Tuesday in December

All that tract or parcel of land lying and being in the City
of Jefferson, 245th District, G.M., Jackson County, Georgia,
and being that 0.48 acre, more or less, as shown on Plat and

L. Venable Jr., Registered Surveyor. Said Plat is recorded in
Plat Book 49, Page 209, Office of the Clerk of Superior Court
of Jackson County, Georgia, and is incorporated herein, and made
a part hereof by reference for a more detailed description. Said
property is bounded according to said Plat on the North by Ralph
Roberts; on the West by Cheatham; on the South by Jeffery W.
Roberts.
There is also conveyed herewith a 20' easement for ingress and
egress running from US Hwy. 129 back to the above described property.
The debt secured by said Deed to Secure Debt, being in default,
said powers contained therein will be exercised and the land
will be sold as property of Jeffery W. Roberts, by the undersigned,
as Attorney-in-Fact for the said Jeffery W. Roberts.
Said property shall be sold subject to any and all outstanding
easements and rights-of-ways, restrictions of record, if any,
and to all unpaid taxes and assessments.
The proceeds from said sale will be applied to the payment of
the above-styled indebtedness, the expenses of the procedure,
attorney's fees (notice as required in Sec. 13-1-11, O.C.G.A.,
1982, as amended, having been sent as required), and the balance,
if any, shall be applied as provided in said Deed to Secure Debt.
Proper conveyance will be made to the purchaser at the said sale
by the undersigned acting as Attorney-in-Fact for the said Jeffery
W. Roberts.
To the best knowledge, information, and belief of Community Bank
and Trust-Jackson, the premises are currently unoccupied.

Tract Two: All that tract or parcel of land situate in the 255th
District of Jackson County, Georgia, containing 133.12 acres,
more or less, more particularly described according to Plat prepared
by James D. Barrett, Surveyor, on August 9, 1962, recorded in
Clerk's Office of Jackson Superior Court in Plat Book 3, Page
483. Bounded on the North by lands of Wilson and Belliue, on
the East by lands of Leachman and Braezeale, on the South by

in said security deed. Default having occurred in respect to
installments of principal and interest and other charges provided

along a straight line back to the point of Beginning. Said described
land being a temporary easement for the construction of a fence
and is shown colored green on the attached plats marked Annex
1-A.
Also to be acquired is 417.04 linear feet of access rights along
the southwestern required right of way line, beginning at the
property line between the lands of the condemnee and the lands
now or formerly owned by Sammie Harrelson at station 16+405.650
on the construction centerline of Georgia Highway Project STP-2434(2)
running southeasterly along said southwestern required right
of way line to station 4+987.955 on the construction centerline
of Windy Hill Road/County Road 104 then southwesterly to station
4+976.163 on said construction centerline of Windy Hill Road/County
Road 104.
The title, estate or interest in the above described lands, required
by condemnor and now taken by condemnor for public use as rights
of way for a Limited Access Highway as defined under the Official
Code of Georgia Annotated sections 32-6-110 through 32-6-119
is as follows: Fee simple title to all the above described lands
as shown colored yellow on the attached plats marked Annex 1-A
and such access rights as may be required between the condemnees
remaining real property and existing roads, streets or highways,
intersecting or adjacent to the Limited Access Highway, such
access rights and lands being specifically delineated on Department
of Transportation plats dated the 30th day of July, 1996; Last
Revised: Sheet No. 10 on July 26, 1999 and Sheet No. 11 on March
29, 1999 and attached to Appendix "A" to Exhibit "A"
as Annex 1-A.
A temporary easement is condemned for the right to construct
a fence. Said easement will expire on December 31, 2003 and is
shown colored green on the above mentioned plats. Upon completion
of the project, the condemnee shall have the right to use the
easement area in accordance with the applicable zoning restrictions,
and the condemnor will cease maintenance of the easement area.
