A Danielsville man was sentenced recently in Madison County Superior Court to 15 years confinement for homicide by vehicle in the first degree.
Alex Clay Fortson, 51, 334 Macedonia Church Road, was also sentenced to 15 years probation for a charge of serious injury by vehicle and fined $1,350. A charge of homicide by vehicle — leaving the scene was merged with the count of homicide by vehicle in the first degree. A charge of hit and run was merged with the count of serious injury by vehicle.
Second charges of homicide by vehicle in the first degree and serious injury by vehicle — along with a charge of DUI alcohol — were disposed of through nolle prosequi, meaning the charges won’t be pursued now but could be brought up later.
Fortson was sentenced to confinement for an accident June 14 of last year on Friendship Church Road that claimed the life of Roy O’Barr, 25, of Toccoa, and caused serious injury to Nathan O’Barr.
