An arrest has been made following a hit and run fatality off Hwy. 53 near New Cut Road in Jackson County Monday afternoon. Billy Eugene Bowers Sr., 51, Gainesville, was arrested Monday afternoon and charged with following too closely, failure to leave a safe distance, failure to maintain lane, leaving the scene of an accident with death, driving under the influence less safe, open container of alcohol in a passenger vehicle, improperly transferred plate and first degree vehicle homicide, a Georgia State Patrol spokesperson said.
According to operator Richard Corn with GSP in Gainesville, David Mcloy Fitzpatrick, 64, of Braselton, was killed on impact when his bicycle was struck in the rear by a Toyota pickup truck that was following too closely on Hwy. 53 north of Braselton. After colliding with a bike, the truck left the roadway and left the scene, said Corn. The operator of the bicycle was thrown off and was reported deceased at the scene. Bowers was arrested in Barrow County and subsequently was taken to the Jackson County jail.
Corporal C.E. Parker with the Georgia State Patrol said after the collision happened, a witness followed Bowers and ultimately stopped him, telling him he struck someone. Bowers called 9-1-1 himself and Barrow County responded and detained him until he could be interviewed, according to Parker.
Parker said the victim was wearing a helmet and was riding his bicycle on the street east bound on Hwy. 53 when he was struck from behind.
